ZDUS proposes to correct past wrongs to pensioners
By 21, April is a public hearing of the proposal for the amendment of the Pension and Disability Insurance Act. According to the Association of Pensioners of Slovenia (ZDUS), which represents 650,000 Slovenian pensioners, the current pension reform should also be used to rehabilitate the unfounded differences and deprivations of some categories of pensioners, which have arisen due to the under-imaginative changes of the current Zpiz-2, which the ZDUS members have long been pointing.
According to the Ministry of Labor, ZDUs’s proposal for statutory extraordinary harmonization would cause new deviations in the amount of pensions up and down. This would happen in individuals who are in the same or comparable position, which may be contrary to the principle of legal certainty, which also destroys confidence in the pension and disability insurance system, according to the MDDSZ.
Although some victims expect a higher pension to recognize a higher pension since their retirement, they propose in ZDUS to rehabilitate the resulting deprivation with statutory extraordinary harmonization of pensions to the affected, with the payment of backwards, from 1 January 2023.
The law should identify only the percentages of the extraordinary harmonization of pensions of the injured pensioners according to the years of their retirement, taking into account the said assumptions of the calculation. With the available data and existing information support with the relevant calculations of the Pension and Disability Insurance Institute (Zpiza), there should be no problems, Zdus said.
At the MDDSZ, however, they say: « If retired in the period 2019-2022 or 2013-2019, improving retirement conditions since 2020 have been perceived as injustice, this would mean that any change for the better in the framework of pension legislation would mean a new injustice for all those who have not received it. »
