The Economic Court of Kyiv ordered LLC « Berezhok » to return to the Kyiv City Council the land plot on the bank of the Desenko River in the Desnyanskiy district of Kiev and to demolish self -constructed houses for recreation.

In 2020, part of the natural territory of the left -bank floodplain of the Dnieper River in the Desnyanskiy district of Kyiv with a total area of ​​314 hectares was declared a landscape reserve of local importance « Desnyanskaya Luke ».

In 2021, during the inventory of the plot, it was registered in the State Land Cadastre with a cadastral number 8000000000: 62: 201: 0030 and was classified as a nature reserve and other nature conservation lands with the type of use – for the preservation of reserves.

In the same 2021, LLC « Berezhok » began to register the ownership of recreation homes. The court register refers to six buildings with a total area of ​​149 square meters. m (from 9 square meters to 60 square meters, they received the first registration for ownership of an individual in 2016). Also on the site appeared 18 temporary structures with awning with a total area of ​​335.5 square meters. m (6 square meters to 50 square meters).

According to the prosecutor’s office, the Kyiv City Council did not make any decisions on the transfer of land to property or use. And since recreation houses are built on a land that is not intended for construction, the property is a self -constructed construction and is subject to demolition, and the plot is returned to the Kyiv City Council.

The head of the Desnyansk District Prosecutor’s Office of Kyiv stressed that the disputed land plot belongs to the lands of the nature reserve and water funds and is subject to the regime of limited economic activity, provided for coastal protective strips. Therefore, this land cannot be used for commercial establishments, especially for construction.

The court took the position of the prosecutor’s office and appointed obstacles to the Kyiv City Council in the use and disposal of part of the plot of the nature reserve fund and part of the territory of the coastal protective strip of the Desenko River, and obliged LLC « Berezhk » to demolish the objects 0.17 hectares and part of the territory of the coastal strip of the Desenko River with an area of ​​0.13 hectares, with their condition for use.

The owners of LLC « Berezhok » are Kievans Victoria Mikhalko and the head of the enterprise Andriy Mikhalko.
