In this way, the commissioner could avoid a prison sentence of more than two years.

Judge Hurtado’s investigation, open following a complaint filed by the fraudist confessed against the Prosecutor’s Office, began with A registration of the attorney general’s office to requisition and sniff in the eight -month content (then rectified and left it in eight days) of the mobile phones, tablets and computers of García Ortiz. An extreme measure to investigate a crime punished with minor penalties and that the judge did not serve to prove anything because the State Attorney General previously deleted the information contained in his devices.

The crime of revelation of secrets investigated by Judge Hurtado has two main protagonists, in charge of monitoring that confidential information that allows others to know it, and who disseminates that information.

Nor has it taken into account the evidence provided by four journalists from El País, who accredited through their internal communications by WhatsApp that were aware of the secret one day before the attorney general asked for the documentation and have placed the origin of the information very far from Álvaro García Ortiz.

To investigate a crime of revelation of secrets released by numerous media, the Supreme Court – hurtado and the Appeals Chamber, for the moment – has decided that the testimony of journalists does not work. The truth does not matter.

As the authors of the revelation of the secret will not confess and the investigation has not achieved solid evidence of the alleged crime committed – the instructor has managed to corner numerous indications otherwise – the daring inferences of Judge Hurtado may end up starring in a trial.
