The Supreme Court confirmed the validity of the National Bank’s decision on the inconsistency of a member of the Supervisory Board of JSC « Bank Avangard » Makara Pashenyuk with qualification requirements for professional suitability.

On April 29, 2025, the Cassation Administrative Court in April 29, 2025 granted the cassation complaint of the National Bank, canceled the decisions of the courts of the previous instance and confirmed the legitimacy of the NBU’s decision on the inconsistency of the member of the Supervisory Board of JSC « Bank Avangard » Makara Pashenyuk with qualification requirements for professional fitness.
The NBU was reminded that his decision on Makar Pashenyuk was justified by the fact that the variable reward in a considerable amount of the member of the Supervisory Board of the Bank « Avangard » was paid without compliance with the requirements of the legislation of Ukraine, without proper grounds and without documentary justification.
And this testified that Pashenyuk conflict of interests in Pashenyuk, as his personal interest in receiving the remuneration contradicted his official responsibilities regarding the control over the implementation of the remuneration policy in the bank, taking measures to prevent conflicts of interest in the bank and facilitate their settlement.
The Supreme Court’s ruling has come into force, is final and is not subject to appeal.
