The deputy USR Stefan Tanasa has submitted to the Parliament a legislative initiative that stipulates that persons definitively convicted for corruption will no longer benefit from special pensions.
‘If a person, a beneficiary of the special pension within the meaning of this law, is convicted for corruption, he will lose this benefit, starting with the definitive stay of the sentence of conviction. Mandatory, the court will make an express mention in this regard, in the decision of the decision ‘, provides for the legislative proposal.
Also, the project also proposes that the court decision of final conviction will be communicated immediately to the competent authorities, which will order the immediately application regarding the loss of the benefit of the special pension. « Any other payments, subsequent to the date of the definitive stay of the conviction decision, are considered void and entail their obligation to restore them, immediately, » the normative act shows.
In the case of the loss of the right to benefit from special pension, the person thus convicted, if he meets the conditions of the law, will benefit from the pension established by virtue of the principle of contributivity.
The person who would know to be the beneficiary of the special pension, but whose pension is not yet paid, will lose this benefit on the date of the definitive stay of the judicial decision for corruption. If, meanwhile, an retirement decision was issued including the benefit of the special pension, the competent authorities will immediately proceed to withdraw the respective act, and will issue a new decision.
The legislative proposal also stipulates that the Government will be obliged to make a maximum of 12 months, through the relevant ministries, to monitor and ensure the implementation of these provisions, drawing in this regard, which will be presented to the Parliament.

The USR states that, ‘unlike other past proposals, the USR project is no exceptions – it applies to all categories that benefit from special pensions, including magistrates’ and ‘covers a wider spectrum of corruption offenses, provided in both the Criminal Code and in Special Laws, such as Law 78/2000’.
