US Federal Court recognized Trump’s tariffs unconstitutional and blocked their action

The Federal Court of International Trade in the US declared illegal imposed by President Donald Trump tariffs, ruled that the Head of State had exceeded its powers.

Details: On Wednesday, a panel of three judges of the Federal Court of International Trade in the US unanimously decided to declare Trump executive decrees on the introduction of large -scale duties on imports of goods from a number of countries.

The Court ruled that the Law on International Emergency Economic powers (IEEPA), which Trump referred to justify the introduction of tariffs, does not give him such powers. According to the US Constitution, Congress only has the right to set tariffs.
« Decrees on world and mirror duties exceed any powers granted to the President … to regulate imports by tariffs, » the court’s decision reads.
The court ruled that Trump’s decrees « declared invalid as contrary to the law. »
In particular, it is a 25 percent duties on goods from Canada and Mexico, 20 percent for Chinese imports, as well as a 10 percent tariff for imports of all US trading partners, which were justified by the need to reduce trade deficit.
The court also abolished the « 20% to 50% of products from 60 countries, which had to come into force on July 9, unless foreign governments were able to reach the White House Agreement by that time.
« We have initiated this case because the Constitution does not give any president of unlimited powers to undermine the economy. This decision confirms that our laws are important and that trade decisions cannot be made by the whimper of the President, » said Oregon Raifield General Prosecutor General.
The White House spokesman criticized this decision and stated that « President Trump has promised to put America in the first place, and the administration seeks to use all the executive levers to overcome this crisis and restore American grandeur. »
Within a few minutes after the announcement of the decision, the Trump administration appealed.
