Urgent request. Modification of the malpraxis system

The representatives of the « Sanitary Solidarity » Federation in Romania claim that it is necessary to urgently modify the Malpraxis system to « limit the damages » products to professionals and patients.

The « Sanitary Solidarity » Federation in Romania argues that the evaluation of the situation of the current system demonstrates « its failure ».

« The possibility of replacing the current model with the compensation of patients for damages is an ideal variant for health professionals and patients. The approach was based on the separate analysis of the damages produced and their compensation for damages, these being designed as deviations from the standards of care. Malpraxis, however, centered on the compensation for damages based especially on mediation, ”says the representatives of the federation in a statement released.

According to the quoted source, in 2024, the total compensation paid to patients by the insurance companies for the cases of malpraxis was 1.5% of the total receipts from the amounts paid by the health professionals. The average cost per insurance has increased double compared to inflation from 2018 to present, while the percentage of damages in the total receipts is 4.2 times lower.

« The ASF data regarding the number of files of damages liquidated or paid partly during the year 2024 are the following: 2 files amicably, 44 files paid by court Malpraxis ”, the statement said.

The most common medical specialties involved: dentistry with 25-30% of cases (eg dental clinics, dental prosthetics), obstetrics-gynecology-15-20% (eg post-partum complications, surgery), general/plastic surgery-15% (eg postoperative infections, technical errors), orthopedics), 10%) articulated, fractures), emergency medicine/UPU-10% (eg late diagnosis, inadequate management), radiology/imaging-5% (eg: erroneous interpretations), others-cardiology, ATI, psychiatry, pediatrics (5-10%).
