U-committee could tip over-Diepresse.com
The Pilnacek and Corona investigation committee is legally questionable, and the Constitutional Court should ultimately decide in a contestation.
Vienna. The FPÖ brought the committee of inquiry on the topics of Pilnacek and Corona in the National Council. Since the freedoms have the necessary mandates, this could now also take place – however, there is a legal hurdle: the object of investigation must also be constitutional. A number of experts doubt that this is the case. Both ÖVP and SPÖ are currently legally examining this question. The further procedure: The constitutional conformity is coordinated in the regulatory committee. If the coalition evaluates them negatively, the FPÖ would remain open to the Constitutional Court for a final legal assessment.
On the one hand, the freedom-demanded committee of inquiry is intended to investigate the death of the former Justice Section Director Christian Pilnacek, on the other hand about the government’s corona measures. This combination is problematic because a single completed process in the administration is intended as the subject of the investigation. However, this has also been interpreted quite broad in the past. The FPÖ now takes an alleged “intimidation of critics” by the Interior Ministry as a content. And in all of the cases to be examined, i.e. both in the Causa Pilnacek and various corona measures.
Greens are interested
Already in the special meeting of the National Council called up by the FPÖ, almost all other parties criticized the range of topics, only at the Causa Pilnacek, the Greens were interested in the content, at least in terms of content. Especially with the Corona chapter, most political groups were located. Alliances are therefore hardly foreseeable, but according to minority law, the FPÖ was able to request the U-Committee on their own.
Despite all the criticism, the FPÖ sees both the necessary implementation of the federal government as well as the certainty and conclusion of the process as well as the direct connection in its request. « We have carefully checked whether this corresponds to the constitution, » said Andreas Hanger from the ÖVP. « Our lawyers look at this in detail, » said Jan Krainer from the SPÖ.
The regulatory committee always decides with a simple majority, the examination scale are the constitutional requirements for the subject of the investigation. The committee can also invite experts for this. He must not change the object of the investigation. However, it is also possible that the FPÖ changes their own desire in order not to have to deal with the VfGH.
Apart from that, the freedoms are preparing another parliamentary initiative: They continue to insist on a live broadcast of the surveys of people of public interest in parliamentary investigative committees. (APA/MAF)
