Trouw: Minister Faber involves inspection, against rules, not in the development of asylum laws

Minister of Asylum and Migration Marjolein Faber (PVV) has not involved the Justice and Security Inspectorate against the rules, in the development of its new asylum laws. That reports Fidelity Sunday evening, based on requested information from the inspection. The inspection was never asked for advice, while on the basis of the instructions on the National Inspectorate and the Ministry’s relationship status, this is required.
According to the regulations, the National Inspectorate concerned ‘at an early stage’ is involved in the design of new laws and regulations. Faber didn’t. In December the inspection sent according to Fidelity An « angry letter » to the minister, after it was heard through a detour that her legislative proposals had been submitted to a number of organizations. « The inspection gets the impression that the in advance of supervision is optional. This is not the case, » wrote that according to Fidelity.

The inspection would have « urgently requested » Faber to seek advice, but the minister never responded to that call. When asked, her ministry announced that this did not happen, because « the parties (were) consulted that are directly influenced by these proposals, or whose tasks are affected by these proposals. » But also the inspection, which supervises the asylum chain as an independent party, says it is touched by the law.
Among other things, the Council of State, the Immigration and Naturalization Service (IND) and the Council for Judiciary were consulted. All those parties responded critically to the content of the new asylum laws. « Do not enter the laws, » the Council of State advised. With the new asylum laws, Faber wants to limit NAAREISAGES options, stricter testing asylum applications, abolishing permanent residence permits and limiting the rights of migrants.
Not gathering advice from the inspection has no direct consequences.
