Roman J. (75 years old) sat behind the wheel of his SUV, when a terrible accident occurred in May last year. He entered the marked crossing in Dywitach (Warmian-Masurian Voivodeship). He did not notice that the 12-year-old went through the belts. The impact was so strong that Krzyś did not survive the accident.

The trial in the case of a fatal accident in Dywitach ended in the Olsztyn court. The accused Roman J. (75 years old) in court explained that he was suffering from gout, hypertension and could get a heart attack at any time. He also assured that he had not seen a boy on his belts.
« I have been traveling fifty years and I have a driving license for fifty -seven years old, » he explained to the court. « I didn’t have an accident in my life or got a ticket or penalty points, » he said. That day he went shopping in Olsztyn. « When I got to the transition, I didn’t see anyone, and when I entered the transition, I felt a blow to the car and on the right I saw a lying boy, » he felt before the court. – I was afraid to give first aid so as not to hurt him. At the time of the accident I had a low speed and I did not brake, because I did not see a pedestrian – he added.

The injuries of 12-year-old Krzysia were so serious that despite the efforts of doctors, he could not be saved. A primary school student had brain swelling and multi -organ injuries. The expert appointed by the court, however, stated that Roman J. was not traveling at excessive speed. It was to move only 30 km/h at the time of the accident.
Although the District Court in Olsztyn found Roman J. guilty of the act accused of him, but sentenced him to only 1 year imprisonment with a conditional suspension of this penalty for a period of 3 years. – A criminal measure was applied to the accused in the form of a ban on driving all motor vehicles in land traffic for a period of 10 years – said judge Adam Barczak. – The court awarded him to three victims with the title of partial compensation in the total amount of 50,000. PLN – he added. The verdict is unlawful.
