Nitra. A 15 -year -old boy who threatened in elementary school with shooting remains in custody. At a non -public meeting, the Regional Court ruled on 15 April.

The incident, after which the eighth excluded from elementary school in Hôrka, became at the beginning of April. The investigator accused him of dangerous threats.

The boy had repeatedly problems with education and behavior, previously excluded from another elementary school. The source says he was also bullied.

Problems were to be manifested after he was “due to a military conflict to Ukraine torn out of the home environment ‘.

Social community protection

The District Court sent a teenager into preventive custody. He expressed concern that in the event of a conflict situation, persistent humiliation or rejection in the community could respond unpredictably.

The accused and his mother also filed a complaint. The advocate wrote that the custody represents a serious intervention in personal freedom, cannot have an educational purpose and has negative effects to develop a juvenile personality.

Among other things, he criticized the court that he was insufficiently dealing with the argument that the boy did not induce verbal or physical struggles with his classmates in the past. He asked for a custody order to cancel.

The Regional Court did not accept the complaints. According to him, the evidence is sufficient to establish a « reasonable suspicion » against the accused. According to him, the intervention in personal freedom is justified by « the protection of a particular social community to the members of which the accused’s threats were directed ».

The court stressed that these are minors who are not responsible and critically evaluated by the impending danger.

The monitoring bracelet was rejected

He evaluated the action of the accused « given the previous behavior » as devious. He wrote that he is uncritical, makes it easier for him, and it is clear that he spends most of his free time on social networks.

If the bond is to replace the monitoring bracelet, it cannot be accused « for a relatively low age » long period of time unattended by an adult. It is currently not included in the educational process (it was excluded from elementary school in Hôrka) and my mother is most of the working day at work.
