The State Duma offered to punish the trains for any offenses against the Russian Federation
The State Duma Committee on State Building and Legislation on April 9 recommended to adopt in the first reading a bill on bringing to administrative responsibility for any offenses committed outside Russia, if they are directed against the interests of the country. As a security measure, the document allows the arrest of the property of the trains. However, the committee invited the authors to finalize the text by including an exhaustive list of offenses.
IN projectintroduced in October 2024 by the State Council (Parliament) of Tatarstan and a deputy from the republic Airat Farrakhov (United Russia), a new version of part 3 of Art. 1.8 Code of Administrative Offenses. Now it says that the legal entity, which are outside the Russian Federation, shall be liable for transactions with property received by criminal means (Articles 15.27.3), and for illegal remuneration on their behalf (Article 19.28), and an individual for participation in the activities of an undesirable organization (Article 20.33), but only if these actions are directed against the interests of the Russian Federation.
According to the Tatar deputies, relayers must be punished for any offenses directed against the interests of Russia.
The explanatory note to the bill states that in connection with the implementation of their abroad, the Russians began to perform public actions directed against the foundations of the constitutional system, state and public security of the Russian Federation. In order to ensure the inevitability of punishment, the authors propose to bring them to administrative responsibility, and in order to “prevent evasion” from it – “apply the arrest of property of a person in respect of whom the proceedings are being carried out about such an offense”.
Before entering the project, deputies took into account the wishes of the government, who supported the initiative taking into account the improvement, and prescribed the procedure for sending procedural documents to the reluctants in respect of which such production is being carried out.
Nevertheless, at a meeting of the committee, his first deputy chairman Irina Pankina (EP) said that the second reading would need to be finalized again, since « the list of offenses should be exhaustive and closed. » This will make the norms working from a procedural point of view, she explained. According to the deputy, the proposed formulation is too wide.
The use of individual interim measures, including the seizure of property, is appointed only by the court and cannot apply to any types of administrative offenses, Ms. Pankina emphasized.
Ayrat Farrakhov in response recalled that the term “interests of the Russian Federation” is widely used in Russian legislation. But the chairman of the committee Pavel Krasheninnikov (EP) did not develop the discussion, stating that before the second reading it would be the opportunity to carefully analyze the amendments. The first reading of the bill is planned on May 13.
It should be noted that initially the bill precisely contained a list of offenses for which the authors proposed to pursue the trains: this is the spread of inaccurate socially significant information (Article 13.15), insulting the head of state, officials and state symbols (Article 20.1), the excitement of hatred or enmity (Article 20.3.1), calls to violate the territorial integrity of the Russian Federation (Article 20.3.2), Discreditation of the Armed Forces (Articles 20.3.3) and calls for anti -Russian sanctions (Article 20.3.4). However, the government in its recall noted that the circle of offenses directed against the interests of the Russian Federation is not limited to these articles. After that, the authors changed the wording and proposed to punish for any offense sent « against the interests of the Russian Federation. »
