The Constitutional Court acknowledged that Jun had violated the Constitution by declaring a martial law reserved for national emergency or warfare.

« Not only did Jun announce the war, but he continued to take actions that violated the constitution and the law, including mobilizing armies and police forces to interfere with the National Assembly, to fulfill his powers, » the court said.

« We, with this, with the following judgment with the unanimous consent of all judges. (We) are repealing defendant President Jun Sukjol, » said Mun Hjunbe, the chief judge.

As the Constitutional Court has approved Juna’s cancellation, new presidential elections will have to be held within two months. If it had abolished the impeachment implemented by Parliament, Jun would immediately resume his presidential duties.

Thousands of Juna supporters and opponents had gathered in the center of Seoul, waiting for the Constitutional Court’s judgment. The police were ready to prevent potential violence.

On the evening of December 3, Jun impressed the country and the international community, announcing the martial law for the first time since the 1980s and sending soldiers and helicopters to Parliament.

On the morning of December 4, the President canceled the martial law after all the members of the National Assembly present called on the president to lift it. On December 14, the Parliament resigned Jun’s office on impeachment.

Jun mentioned the role of opposition as a reason for determining the warting, accusing it to sympathize with North Korea. Since the end of the Korean War in 1953, there was a martial law between South Korea and North Korea, as the war ended with a ceasefire rather than a peace treaty.
