The ex-colonel received a 13-year term for corruption crimes and could not conclude a contract for participation in his own. Of the defendants in this case, only one achieved a little mitigation of the punishment in the appeal instance due to the expiration of the statute of limitations.
On April 9, the second Western District District Court completed the consideration of the appeals of the defendants of the so -called CSKA affairs. Earlier, the garrison military court of Moscow found Mikhail Baryshev guilty of receiving bribes in 2016-2017 (part 6 of article 290 of the Criminal Code) in the amount of 8.3 million rubles, 1.6 million rubles, 10 million rubles. and 3.9 million rubles. Despite the fact that the lawyers from the criminal case, due to the expiration of the statute of limitations, managed to achieve the exclusion of five episodes of abuse of authority (part 1 of article 286 of the Criminal Code), and from the prosecution of bribes to remove their extortion, the verdict was extremely harsh. The head of the army club was given, as for murder, 13 years of strict regime with a ban on the provision of leadership positions in the civil service for 10 years (the accusation requested 17 years “Strogach”), deprived of the rank of colonel, as well as orders of honor and friendship.
Former deputies of Mr. Baryshev for CSKA Andrei Khamazin and Yuri Mukhanov, who directly participated in bribes and theft, received conditional terms of six and five years, as they actively cooperated from the TFR. And Dmitry Larchenkov, who led CSKA after the departure of Colonel Baryshev in the Main Directorate for Work with Personnel, was finalized.
But the former assistant to Mr. Baryshev Maxim Labuntsov and the head of the CSKA department Oleg Amplogov, including for the commission of corruption crimes, were sentenced to eight and five years in prison. In the same case, the beneficiary of the Five Semarok transport company Alexei Knyazev, one of the service providers at army games, was convicted. He was found guilty of fraud, setting a term of three years of general regime.
According to Kommersant Mikhail Baryshev Konstantin Andreev, in an appeal, the defense was concentrated « on the facts of obvious and undeniable violations. »
So, the defender noted, part of the first “bribe” from the company “Forward”, for which Mikhail Baryshev received the largest – at nine and a half years – the term was actually transferred by this company to the Foundation of the Olympic champion Svetlana Khorkina. At the same time, Mrs. Khorkina, in the investigation and in court, indicated that the money from the “striker” was spent on the authorized goals of the fund and not transferred to Mr. Baryshev.
With the second part of the bribe, according to the same episode, the court connected the free receipt of CSKA for the sports form of the “striker”, namely bribes in the form of property. However, the assessment of its value was neither by the investigation nor the court, but was determined based on the documents of the bribe taker, the defender emphasized. He noted that senior officials of the military investigation and prosecutors, officials of various ministries and departments who visited military games as honored guests received the same form.
The representative of Mr. Baryshev said that the investigation learned about other corruption episodes from the notebook of actor Alexei Ogurtsov. This notebook appeared in an unexpected way in the materials a year after the initiation of a criminal case. In it, the intermediary of cucumbers described the dates of meetings and the amount of the transferred money. Based on this notebook, the investigation, and then the court established the beginning of the course of the crime. However, the original of the notebook itself, Mr. Andreev noted, despite numerous petitions, did not see.
In general, the defense managed to achieve only changes in the punishment of Maxim Labuntsov: from his prosecution due to the expiration of the statute of limitations, Art. 337 (unauthorized abandonment of the place of service) of the Criminal Code. As a result, he was chosen for six months.
Representatives of convicts plan to contact the cassation military court (Novosibirsk). In parallel, according to Kommersant, Mikhail Baryshev is trying to conclude a contract with the Ministry of Defense and go to his own. However, the court has not yet received the relevant petitions for it from the units of the military department.
