The regions want to fine themselves for the wrong parking

Regions may receive the right to fine violators of parking rules without the participation of the traffic police. The corresponding bill introduced to the State Duma the Legislative Assembly of the Perm Territory. The document was supported by the authorities of four more regions. Now the parking violators have the right to fine in Moscow, St. Petersburg, the Moscow Region and Sevastopol. Similar powers are needed by other entities where the traffic police cannot cope with the administration of violators, the authors of the amendments say. The expert sees the risks that the regions will combine the functions of the organizers of the movement and controllers, using this to fill the budgets at the expense of fines.

On June 16, the Legislative Assembly of the Perm Territory introduced the draft amendments to the Code of Administrative Offenses of the Russian Federation, which gives regions by the right to independently, without the participation of the traffic police, to administer the violations provided for in Part 4 of Art. 12.16 of the Code (non -compliance with the requirements prescribed by signs or markings prohibiting stopping or parking vehicles). After the adoption of the amendments, the regions will have to conclude an agreement with the Ministry of Internal Affairs on the transfer of powers.

The right to administer parking violations was first introduced in 2013 for the authorities of Moscow and St. Petersburg. The powers of the subjects were expanded to unload the traffic police and increase control of the violators. In 2023, additional amendments were made to the Code of Administrative Offenses, which had shown similar functions of the government of the Moscow Region and Sevastopol.

Perm deputies complain that the number of local parking violators is growing, the traffic police does not cope with administration.

“In large cities, the number of drivers held liable for violations of the rules, and the total number of violators of these rules may vary ten times,” the explanatory note says. As evidence, deputies give statistics in the Perm Territory, where the traffic police annually makes 17-18 thousand decisions for violation of the rules of parking, or on average 49 decisions per day. But the actual number of violators in the center of Perm is about 20 times the number of fines. Local authorities are interested in reducing the number of violators, but they have no authority to solve the problem, deputies complain.

Documents on the position of the authorities of the Krasnodar Territory, the Nizhny Novgorod, Ryazan and Tula regions were attached to the materials of the bill: they all support the initiative and are ready to assume new powers. The regions declare a “technical” readiness to record violations using road cameras. The Government of the Ryazan Region gives its statistics, according to which under Part 4 of Art. 12.16 Administrative Code of the Russian Federation traffic police annually issues about 12-13 thousand decisions, their number is not reduced, which means that control over violations is ineffective.

In the financial and economic justification, the deputies recall that from January 1, 2025, 25% of all fees from fines for violations of the SDA are sent to the federal budget, 75%-to the regional. In this regard, federal support for the adoption of amendments is not required.

The Government of the Russian Federation did not initially support changes (the corresponding conclusion of July 22 was submitted to the State Duma in the general package of documents). Deputy Prime Minister Dmitry Grigorenko pointed out that the first edition of the amendments did not allow the police to initiate cases if the traffic police officer independently identified a parking violation. The government also indicated data insufficiency confirming the readiness of the regions to obtain new powers. All these comments were taken into account in the editorial office, according to the head of the Legislative Assembly of the Perm Territory Valery Sukhikh. Whether the government supports the current version of amendments is unknown.

The head of the Probok.net expert center, Alexander Shumsky, confirms that the problem with the lack of traffic police officers exists.

“On the other hand, it is dangerous to give the regions to the regions,” the expert believes. “There is a risk that this can turn into a collection of money without the opportunity to appeal at least something and without the opportunity to prove that the camera was mistaken or the parking inspector was mistaken. Here we need a system of checks and counterweights. Because now, if you are a driver and mistaken, then you will be fined. If the system or inspector was mistaken, then the fine can be appealed and canceled, but no one will bear responsibility for the mistake. ” “Local authorities are more interested in restoring the roads,” thinks a member of the Public Chamber Alexander Kholodov. “And it is obvious that if the powers are transferred, then there will be more and more fines for the parking. The experience of Moscow and St. Petersburg has already shown this. The traffic police, in turn, are freed by their hands, they begin to work more on « their » compositions related to the safety of movement. «
