The Prosecutor’s Office | Opinion | The country

Leo with great interest the book of my friend Miguel Pasquau Liaño, Judge and novelist, entitled The trade of deciding (Debate, 2025). It is very interesting to get into the skin of someone who supports the power of the State to make a decision that affects people’s lives. Their meditations put the knowledge of the right to decide between prejudices, parallel judgments, testimonies, evidence, indications and suspicions. Miguel Pasquau acknowledges that judges can be wrong, and that implies a responsibility, because the Judiciary does not rest on the CGPJ, which does not issue sentences, but in the judge who signs a resolution. In a treaded media world, There are many pseudoperiodists willing to draw fanatic conclusions without even having read a sentence.

While reading The trade of decidingI have felt the desire to clarify certain feelings. I don’t believe now that the problem is that Conservative or progressive parties manipulate judges. If there was an unequivocal professional decency, this evil desire would have no major consequences. More than in the parties, the problem is in the judges that come out of their professional decency to replace the will of the people embodied in politics. They take advantage of the tension and seek prominence, turned into a social authority without limits that does not distinguish between complaints, evidence, indications and suspicions. If this type of judges manages to turn their superb into legal custom, A self -modest judiciary It will become the most serious problem of democracy.

After the CGPJ was blocked, the only counterpower that can face judicial pride is the Prosecutor’s Office. Now I understand why we endure in Spain an excessive media persecution against the Attorney General. There are those who do not want justice, but a superb without limits willing to erase any other type of democratic power.
