At the request of the District Prosecutor’s Office in Tarnowskie Góry and the director of the Penitentiary Institution in Wronki, the District Court in Tarnowskie Góry was pending proceedings regarding the referral of Marcin J. for forced treatment in a closed center. It was argued that he is mentally ill, unable to exist and threatens the safety of his own and others. The proceedings were closed. Marcin J. studied experts. The court did not agree to the request of the prosecutor’s office and the prison service. The prosecutor’s office appealed to the District Court in Gliwice, and in February last year he also found no reason to close Marcin J. in a psychiatric hospital.

– This is not enough – says Dr. Jerzy Pobocha, a psychiatrist and court expert. – The bracelet is only information where a person stays. We also do not know what area such a person is monitored, and the Silesian-Zagłębiowska agglomeration is a great cluster of cities and people. The bracelet does not protect potential victims. Parents rightly do that they are informing about the place of this man’s stay. These are correct, social behavior, not a hunt for an innocent man – says Pobocha. He adds that pedophilia must and can be treated. – As part of serving a punishment, a person with a pedophile tendencies should be treated. It is different with us – sums up Pobocha.
