The Office of Conflicts of Interest will have to investigate if Sanchez had to refrain from the rescue of Air Europa | Spain
The Superior Court of Justice of Madrid (TSJM) has ordered the Office of Conflicts of Interest to investigate whether Pedro Sánchez had to refrain in the decisions taken by the Council of Ministers on the rescue of Air Europa in full pandemic. The Contentious-Administrative Chamber has accepted a resource presented by the PP against the Decision of the Archive Office The complaint of the popular to inquire about the linkage of Begoña Gómez, wife of the president of the Government, with the airline. The magistrates have concluded that the office did not make a « minimum » investigation before giving folder to the matter and, therefore, urges him to collect new data.
The PP has celebrated on Tuesday the new TSJM resolution and has taken advantage of it to load against the Executive, framing it within the different judicial fronts that the government has open. The president of the conservative party, Alberto Núñez Feijóo, The content has advanced during an intervention in Congress: « The Superior Court of Justice of Madrid estimated the appeal of the PP and forces to investigate the president of the Government for his possible participation in a conflict of interest in the rescue of Air Europa. »
In mid-2024, the PP went to the contentious-administrative route after the Interest Conflict Office filed its complaint. The popular stated that Sánchez should have refrained in the deliberations about the rescue of the airline due to the supposed relationship of Begoña Gómez with the company and the influence that, according to Elucubran, could have had – a suspicion qualified as “conjectures” by the Provincial Court of Madrid.
However, after collecting a report by the Secretariat of Presidency, the office understood that « there is no assumption provided for in the rule that allows the president of the Government to have been able to incur a cause of abstention that forces to initiate a investigation procedure. » The report argued that the « decisions taken in the sessions of the Council of Ministers did not affect personal interests (of Pedro Sánchez), neither own nor to those of their spouse, nor did they assume any benefit or harm to them. » In addition, the document added that « the president of the President has no labor or professional relationship that implies the exercise of management functions, advice or administration in the companies subject to the decisions adopted. »
The TSJM does not enter the bottom of the matter and is limited to affirming that the office, beyond requesting that presidency report, did not collect other data. « (PP) is legitimized to file a complaint and to challenge a file decision for not having carried out a minimum investigative activity to adopt a decision, » says the sentence, dated June 6 and the one that the country had access. The Court Apostille that other « evidence » must now be practiced to adopt a « founded decision » in this regard, which can be the archive again: « but motivating the same and with reasonable base actions. » The PP has already claimed that reports be requested from the Treasury, the Social Security and the Complutense University of Madrid (UCM), among other entities.
