The Narva Museum won by court disputes in the amount of over 600,000 euros
Tsu “Narva Museum” (SA Narva Muuseum) won litigation against the State Center for Auxiliary Services (RTK) in the case related to the financing of the reconstruction of the Convention building and the northern wall of the Narva Fortress, the press service of the museum reports. The dispute concerned the correctness of the use of funds allocated to the museum from the structural funds of the European Union.
RTK saw a violation of § 123 of the law on public procurement (RHS) when amendments to the contract – in the part where the museum allowed the fulfillment of the obligation to provide the contract by deductions from accounts, instead of providing a guarantee letter. Before making these changes to the contract, the museum was consulted both with the executive body and the Ministry of Finance. Nevertheless, RTK considered these changes unacceptable and, in the decisions of 2021 under an agreement on the reconstruction of the Convention building and 2022 under the reconstruction agreement of the northern walls, recognized as non -power expenses for a total of about 900,000 euros.
In March 2023, the Tallinn Administrative Court canceled the RTK decision on financial adjustment under an agreement regarding the repair of the Convention building. RTK appealed this decision in the Tallinn District Court, but in March 2025, he left an appeal. RTK also calculated the museum’s unreasonable complaint under an agreement regarding the reconstruction of the northern wall. The administrative court of Tallinn also canceled this financial correction, the court decision entered into force in May 2025.
In court, the interests of the Narva Museum were represented by the jurisdiction of Christina Uwetaa-Tepper (Tepper & Partnerid Law Bureau), who noted that court decisions confirm the legality of the changes made to the treaty agreement: “Both administrative and district court agreed with our arguments. This, of course, is one of those iconic decisions that can influence similar disputes of other public sector institutions. We are grateful for the confidence of the client, who gave us the opportunity to represent his interests in such a significant matter. ”
Maria Smorzhevsky-Smirnova, a member of the Board of the Narv Museum, emphasizes that we are talking not only about a financial victory: “For us, this is primarily the restoration of justice-in relation to the Narva Museum and its employees. We are grateful for the independence of the judicial system and are glad that our arguments were heard. The returned funds will allow the museum to continue the preservation of cultural heritage, develop projects and work confidently even in an economically difficult time. ”
At the time of the publication of the press release, the Narva Museum received a full return of all funds withheld RTK, including about 45,000 euros in court expenses and interest at unreasonably withheld;
