The Ministry of Emergencies is going to change the rules for ensuring safety on the beaches. In the draft departmental order, the norm is forced to swim in a drunken form for the first time. The document will also be stipulated that the bathing area should be no more than 1.2 meters, and the border of the water area designed for bathing is indicated by buoys. Innovations are needed to reduce the number of incidents on the beaches, explain to the Ministry of Emergencies, but the expert believes that the prohibitions on safety will not affect.

The Ministry of Emergencies published on Regulation.gov.ru The draft order with the new rules for ensuring security at water bodies, including on the beaches. Today, these rules are approved by order of the Ministry of Emergencies No. 732 of 2020, which will cease on September 1.

At the same time, the obligation of the organization responsible for the maintenance of the beach appears to establish “safety signs” on the coastal strip to indicate the border of the bathing zone. If the beach is drew out of operation, its owner is obliged to put an information stand 15 days before the date of closure. In the Ministry of Emergencies, the meaning of the “Kommersant” request was not explained. The document is accepted to reduce incidents at water bodies and the deaths of people in them, the explanatory note is said, but there is no statistics.

The order also first appears a ban for beaches to swim in a state of intoxication. The current legislation prohibits drinking alcohol in public places, including within the boundaries of territories occupied by beaches, ponds, lakes and reservoirs. The penalty for violation is 500-1.5 thousand rubles. However, there is no separate ban on “drunken bathing” for visitors to beaches.

“With the adoption of new rules, the regulation zone is expanding, the instrumentation of the regulatory authorities to suppress dangerous situations on the beach will become wider,” says Maria Yakovleva, director of the Yakovlev and Partners Law Group. Now, she explains, if a person came to the beach in a drunken form, but did not drink alcohol directly there, he is not forbidden to enter the water: new rules introduce a direct ban on this action, regardless of where alcohol was consumed.

“The legislator believes that bathing in a drunken form is a more socially dangerous act than the appearance on the beach at a state of intoxication,” adds Alena Grishkova, adviser to Pen & Paper.

“The bathing is intoxicated by the likelihood of an accident,” says narcologist Alexander Kovtun. “The person is less vigilant, the person may not be able to correctly evaluate his capabilities, it is more difficult for him to understand that the situation is dangerous. Alcohol worsens the reaction, which increases the risk of drowning. ”

There is no separate article by the Code of Administrative Offenses of the Russian Federation for violation of the new norm, Maria Yakovleva explained, but there are norms of regional laws, for example, a fine of 5 thousand rubles is in effect in Yakutia. For swimming in a drunken form in « unauthorized places. » In theory, says Ms. Yakovleva, in the case of aggressive behavior of a person on the beach, Article 20.1 of the Code of Administrative Offenses of the Russian Federation “Minor Hooliganism” may be applied (provides for arrest up to 15 days).

The head of the Mordovian branch of the All -Russian Society Savior on the waters Valery Evdokimov believes that new requirements on the beaches will not increase. “After all, the prohibitions existing now are not respected,” the expert explained “Kommersant”. “The signs are hanging, red flags are exhibited, but people still bathe when they want and where they want. It’s hard to stop it. ”

The remaining norms in the project migrated from the current order. Visitors to the beaches, as today, will be forbidden to swim on boards, logs and sunbeds; shift the fences denoting the bathing zone; Dive into the water outside the pier and other places specially adapted for this. There is a ban on bringing animals with them with the exception of guide dogs. The owner of the beach will be obliged, as before, to introduce a ban on swimming at a wind speed of more than 5.5 meters per second or the occurrence of waves with a height of 1.2–1.5 meters.

The draft order was developed by the Ministry of Emergencies in connection with the Federal Law “On the Security of People at Water Countries”, which enters into force on September 1, 2025.

As a by -law act, the Ministry of Emergencies developed new rules for using small courts for the same document (see “Kommersant” of April 8). In them, among other things, it is stipulated that the owners of the crafts will have to bring the identity card with them, and inspectors in small courts will have the right to verify the document.
