The Minister of Justice comments on the annulment of the CCR decision
The Minister of Justice, Radu Marinescu, said on Thursday that the legislation, at the moment, does not allow the adoption of specific solutions to the administrative contentious suspension or annulment by the courts of some decisions or decisions of the Constitutional Court.
The statement comes after a judge from the Ploiești Court of Appeal admitted, on Thursday, an application requesting the suspension of the CCR decision on December 6, 2024 by which the presidential elections were annulled.
‘I also noticed the existence of such a court decision. We are going to analyze the context in which it was adopted, to determine to what extent the institutional attributions of our ministry can be exercised regarding the exercise of disciplinary verifications, since, strictly at the theoretical level, there are no remedies in the Romanian legislation by which decisions or decisions of the Constitutional Court, which are not administrative acts. According to the minister, the presidential elections in May are not affected by the decision of the Ploiești Court of Appeal.
« If we are to analyze the effects of such a court decision, you will observe that the administrative acts that have been adopted by the Government in organizing the elections are not concerned by this court decision, are not suspended or annulled and, consequently, the organization of the elections continue to have effects, so that we will still have elections, » Radu Marinescu explained.
The Ploiești Court of Appeal suspended the execution of the decision by which the Constitutional Court of Romania annulled the presidential elections of December 2024.
The RCC decision was challenged at the Ploiești Court of Appeal by a natural person, Gheorghiță Popescu, according to the data on the portal.
The judges of the Ploiești Court of Appeal accepted the appeal regarding the suspension of the CCR decision.
The court’s decision in Ploiești was taken ten days before the first round of the presidential elections.
