The market filed remarks to the bill on counteracting scammers

This week it is planned to consider in the second reading a bill on the creation of the Antifrod and Anti -Fishing platforms. Associations of the financial market sent their comments on the finalization of the document, many provisions of which are considered excessive and difficult to comprehensive. The main claims are reduced to the prohibition of communications with clients through foreign messengers and the requirement to use only a single biometric system for additional customer authentication.

At the end of last week, the collection of comments ended in the second reading of the bill regulating the creation of state information systems (GIS) Antifrod and Anti -Fishing, which was adopted in the first reading on March 18. The project provides for comprehensive changes to the legislation of the Russian Federation aimed at preventing, suppressing and strengthening liability in relation to unlawful acts committed using information technology. After introducing the bill to the Duma, representatives of the financial community appeared to him many questions (see “Kommersant” from March 11 and 17).

By the second reading, a large number of associations of financial market participants filed their comments to finalize the document. As the President of the Association of Russian Banks, Anatoly Kozlachkov, told Kommersant, it is advisable to resolve the use of commercial biometric systems as an alternative to a single biometric system to reduce the financial burden on market participants. In addition, in his opinion, special attention deserves the provision on the ban on the use by banking employees of foreign messengers to interact with customers. “It is proposed to exclude this norm, since this restriction will rather create inconvenience for citizens, but will not prevent fraudulent calls,” says Anatoly Kozlachkov.

In turn, the Chairman of the Association of Participants in the Electronic Money and Cash Translation Market, Viktor Prostosta, draws attention to the fact that the current legislation is prohibited by the use of a number of foreign services to collect personal data and transfer payment information. “For daily working communications that do not contain confidential information, employees should not be limited in the use of messaging services,” he says. The head of the National Council of the Financial Market (NSFR) Andrei Emelin notes that tariffs for telephone and SMS are constantly growing. According to him, banks, guided by a client -centric approach, are guided by customer preferences and try to use the available and most convenient channels for them to bring information. Meanwhile, as Kommersant explained in the apparatus of Deputy Prime Minister Dmitry Grigorenko, we are not talking about all ways of communicating banks with clients, but only to ban citizens’ calls through messengers, which are regularly used by scammers.

At the same time, by the second reading, the market participants had new comments and suggestions for the text of the bill. So, according to the conclusion of the Public Chamber, prepared based on the results of the public examination of the bill, the document establishes the procedure for the creation and functioning of these GIS. They drew attention to “the absence in the bill determining the specific list of information to be included in these information systems, which, in turn, can create uncertainty in law enforcement practice,” the review said. “The introduction and support of GIS is objectively associated with the cost of software, equipment, ensuring cybersecurity, technical support and training of personnel,” says Yevgeny Masharov, member of the Commission on Public Examination of bills and other regulatory acts of the Public Chamber. The Association of Banks of Russia noted that the bill is proposed to be supplemented with norms that provide the possibility of submitting customers to credit organizations of applications for the establishment or withdrawing of credit self -embodiment through banking channels: “The amendments are submitted excess and economically unreasonable.”

The NSFR consider it advisable to directly indicate in the bill that the interaction of financial organizations with both GIS will be carried out on the basis of already functioning automated systems using the Bank of Russia infrastructure in one window mode. “Credit organizations, as well as other money transfer operators … Already now sending information about cases and attempts to carry out operations without the voluntary consent of customers, which is accumulated in an automated financial processing system,” the NSFR notes. This initiative was supported in the Central Bank, informing Kommersant that it is advisable to use ASOOi Finzers to interact with the platform and integrate ASOI into a designed platform. “Technical issues of integration can be taken into study after the adoption of the relevant norms,” the Central Bank said.
