The leader of the Extremaduran PSOE will remain in their institutional and organic positions until there is a sentence | Spain

The general secretary of the PSOE of Extremadura, Miguel Ángel Gallardo, will keep his institutional positions and organic despite the decision of Judge Beatriz Biedma to sit on the bench of the defendants together with the brother of the president of the Government, David Sánchez, and nine other people accused of crimes of administrative prevarication and influence peddling.

The PSOE Ethical Code establishes that once oral trial opens, socialist leaders have to step back, but the case of Gallardo is conditioned by two special circumstances. On the one hand, that the judicial decision occurs just one day after Gallardo collected the deputy minutes in the Regional Assembly (although it will not be clustered until the Constitution in a plenary session of the Chamber) and, on the other hand, the internal norms of the PSOE are more flexible for the cases in which there are indications that they are being victims, according to the party, of a political persecution, after a statutory modification approved in the Federal Congress approved in the Federal Congress of Seville last November.

Sources of the Socialist Directorate explain that « the Ethical Code has not changed », but the statutes include a new disposition for its interpretation. « The affected can make a request to the Ethics and Guarantees Commission based on the sixth additional provision of the statutes, stating that the complaints come from extreme right organizations, and that the sentence can be expected, » Ferraz sources explain. What establishes the aforementioned Ethical Code is that any “public or organic office of the PSOE to which an oral trial is opened by a criminal procedure will resign from its position at the same time in which it is transferred from the order of opening of the same and will request the voluntary decline”. Otherwise, the document adds, « it will be suspended precautionary of militancy and, where appropriate, expelled from the party. »

Waiting for it to decide if the Superior Court of Justice of Extremadura assumes the case, due to its new condition of aggorated, what seems clear is that the direction of the PSOE will not ask Gallardo to take a step back. For Gallardo to be a deputy, a parliamentarian, Mari Cruz Gallardo, and four other members of the candidacy have had to give up taking the act. On Wednesday it transpired that the former deputy would be the new subdelegate of the Government in the province of Badajoz, an operation that was frustrated hours later, with the sharp denial of the delegate in the community, José Luis Quintana, which confirmed the continuity of the current sub -delegate.

In an interview in RNE, Gallardo has tried this Thursday, the waters, explaining that the resignation of Mari Cruz Rodríguez in the Assembly of Extremadura to leave him hollow without promising anything in return. « When he decides to step back, and that I appreciate it, he does it from responsibility, but above all with nothing in return, » he said. Among the most critical voices with the situation is that of the president of the Diputación de Cáceres, Miguel Ángel Morales, who has shown his « concern » and « sadness » for the situation of the PSOE in Extremadura. « I cannot be a goal because I do not know the ins and outs, I am worried because I do not like the negative news for my party, because they do not harm a person, they do not harm the leaders, they harm an organization that I carry in the heart and that is very important for this country, » he said.

Morales, who has been provincial secretary of the PSOE of Cáceres for 13 years and did not support Gallardo in primary, has said that « as a militant » has no « objective criteria » to comment on what has happened because « nobody » has informed him of anything by not having organic responsibilities in the party. « What I know is by the media. And what appears in the media are worrying news for the party. I always put the interests of my party, of a Centennial Party, of a party that has represented the best of Spain and Extremadura.
