The law of magistrates’ pensions, electoral trick? « It is intentionally unconstitutional »

The USR deputy, Oana Țoiu, says about the law on the pensions of the magistrates, which was adopted, on Wednesday, by the plenary of the Chamber of Deputies that it has provisions that violate previous decisions of the Court.

Țoiu stated that this law is intentionally unconstitutional.

The draft law is to go to the Senate, which is the decision -making chamber for this draft law.

« The law that was sent to Parliament, you know, obviously, during the election campaign and I do not think it is coincidence, it is intentionally unconstitutional. It has provisions that violates previous decisions. We have filed amendments to repair it and to do it constitutionally and here something very interesting happened. said Oana Țoiu to B1TV.

« Today, when I arrived in the plenary, I think they realized that it is too obvious what they did, maybe there were news in the evening, which made them realize that they could not boast, however, with something so obviously wrong, they summoned us in a session parallel to our plenary, where they adopted a part.

For example, there is also good news, namely, that we managed to close the gate through which the income was inflated during the last month of activity, so that the maximum ceiling until the special pension could reach the salary. And this is a principle of common sense, not to have the pension higher than the salary, that people who continue to work are not punished with less financial resources than those who choose to close their career in the judiciary and to retire. This is the good news, the bad news, however, is that they made a clearly unconstitutional provision, ”said USR deputy.

« In fact, more, and they also partially recognized in debates, that sure the law has some problems, but it can repair their Senate. From our point of view, it is an electoral trick and so on. It is the same trick they tried last year, when they gave an election campaign and promised increased pensions for the military, and what we have to do, After the vote ”, Ţoiu explained.

Asked if the law could, at this time, fall to the RCC, Oana Țoiu replied:

« Most likely … there are previous decisions of the Court that contradict as clearly as possible the way the law is made now. »

The plenary of the Chamber of Deputies adopted, on Wednesday, the draft law on the pensions of the magistrates, initiated by the leaders of the ruling coalition, with 259 votes ‘for’, one vote ‘against’ and 25 abstentions.
