The largest PVC production in the lawsuit of the Prosecutor General’s Office was seized in state revenue
As it became known to Kommersant, the Khamovnican District Court of Moscow turned the assets of the largest producer of polyvinyl chloride (PVC) – JSC Sayanskkhimplast worth more than 92 billion rubles in Russia. Thus, the court granted the claim of the Prosecutor General of the Russian Federation against the actual owner of the enterprise, the former head of the Legislative Assembly of the Irkutsk Region, Viktor Kruglov, as well as his family members. The decision made is addressed to immediate execution.
In order to consider the case, Judge Natalya Shevieva required only two court sessions, during which she listened to the arguments of the parties and sided with the applicant.
The Prosecutor General’s Office claimed that the ex-deputy violated a number of federal laws, in particular “on the fight against corruption”, which prohibits combining a government position with business, but obliges to provide complete and reliable information about his income.
Checking such data obtained from Mr. Kruglov, supervision established that he hid the information about the ownership of him Sayanskhimplast JSC and other societies, « actively conducting entrepreneurial activities in the Irkutsk region and withdrawing income for himself and his close relatives contrary to established anti -corruption prohibitions. » It should be noted that Viktor Kruglov from 2000 to 2016 was a deputy from United Russia in the Legislative Assembly of the Irkutsk Region, a member of the Committee on Property and Economic Policy, and in 2004-2008 he headed the regional parliament.
Earlier, since 1987, he held leadership positions at Sayanskhimplast JSC, which is the city -forming enterprise of Sayansk and the largest large -capacity manufacturer of chemical products of chlorological profile (polyvinyl chloride, kaustic soda). All this is widely used in the field of mechanical engineering, as well as in the manufacture of medical products and building materials. The society is of strategic importance for the security of the state, since the products manufactured by it are involved in the military-industrial complex in the release of weapons and military equipment components.
The Prosecutor General’s Office indicated that, having become the general director of the plant in 1997, Mr. Kruglov decided to “turn the state -owned enterprise in their favor”.
For this, As I previously wrote « Kommersant »in 1997–2000, subsidiaries were established by subsidiaries, the authorized capital of which the production capacities of Sayanskihimprom OJSC were displayed.
Subsequently, the general director seized the “daughter” from the enterprise management, issuing them for specially created companies that he affected. At the same time, Viktor Kruglov himself actually acted as a seller and buyer of shares and shares of legal entities, the lawsuit was noted. Later, Sayanskhimprom OJSC was bankrupt, and all profit and production funds were displayed into the enterprise specially created by Mr. Kruglov – JSC Sayanskhimplast. Thus, state production facilities passed into private hands.
As a deputy, the defendant, as the prosecutors established, used his position to receive Sayanskchimlast of profitable contracts, as well as tax benefits.
Supervision notes that Mr. Kruglov brought income received from the enterprise’s activities to the accounts of offshore enterprises, in particular, to Cyprus. In 2014, as a deputy, he received the citizenship of this country, not notifying this Ministry of Internal Affairs, but did this after the addition of his authority in March 2016. In the same period, he re -registered 100% of the shares of Sayanskhimplast JSC.
“In order to conceal illegally acquired property, for a long time he formalized him on his relatives living in the Republic of Cyprus, as well as having the citizenship of this country, his son, daughter and wife,” the lawsuit said. It was noted that the property was made as contributions to the authorized capital of a number of firms that are engaged in the management, production and sale of Sayanskihimplast products: LLC Businessintellect (its assets are estimated at 643 million rubles), Sayanskgazobiton LLC (2 billion rubles), LLC BUSINESS (4.6 billion rubles) and LLC Vector LLC) and Vector LLC) (6.4 billion rubles).
The prosecutor’s office asked the court to turn the shares and shares of these enterprises with a total value of 92.4 billion rubles to the income of states.
In addition to Viktor Kruglov, the defendants were the lawsuit by his wife Irina Kruglova, children Anna and Alexander, as well as the former first deputy head of the administration of the Irkutsk region and the ex-gender of the enterprise Nikolai Melnik. They did not recognize the lawsuit. However, none of the defendants in court personally appeared, and their interests in a closed process were represented by lawyers. The defendants could not receive promptly comments, they previously stated that the justified objections were submitted to the lawsuit of the Prosecutor General, and the activities of the Sayanskkhimplast were built on compliance with the principle of legality.
However, having evaluated the information of the parties, the court found the arguments of the Prosecutor General’s Office justified and satisfied the plaintiff’s request. At the same time, in order to prevent the withdrawal of capital abroad, the court decision at the request of the prosecutor was addressed to immediate execution.
