The judgment for Michael’s murderer is determined – gets 14 years in prison
It was at noon on April 10 last year that it 39-year-old Mikael was shot to death in a subway tunnel in Skärholmen. The deed happened before the eyes of his son who also came to become a key witness during the investigation.
Last spring the district court sentenced the shooter – who was 17 years old at the time of the shooting, but has now reached the age of 19 – for murder of Mikael. The sentence was 14 years in prison, the longest sentence that can be sentenced to a person under 18 at the time of the crime. At the same time, it was pointed out that if the young man was a month older at the shooting, he would have been sentenced to life imprisonment.
Shortly after the district court’s judgment requested the shooter to make an additional hearing. It surprised many. Previously, he had been silent through the investigation. Now the case took a turn when he instead claimed that the shooting was an accident.
During the court proceedings, the shooter said he asked Mikael to leave the subway several times and directed a gun at his face. But Mikael should not have listened and instead pressed him against the tunnel wall.
– Mikael jumps on me. Press me against the wall. He pushes me hard, said the young man before the court.
According to the now murdered The shots were accidentally fired when Mikael grabbed the weapon in the subway. During the court proceedings, the defense also stressed that Mikael had 1.3 per cent in the blood at the time, which may have affected his own actions – namely to have. Not backed when targeting a gun at him.
– I want to be clear that the fact that Mikael was affected by alcohol has been known all the time. It does not in any way affect our assessment, Erik Lindberg said at a press conference after the verdict was announced.
On Thursday, a unanimous Svea High Court established the district court’s judgment. There was no importance to the now being convicted of description that it was an accident. It is also believed that he is disproved thereof.
The High Court has In its assessment, weighing in that as many as three shots have been fired, that they were shot in two sequences with a certain, shorter period of time, that the shots have hit in different places on Michael’s body and that the pistol’s trigger has had to be pressed for each shot. All in all, it means that the now 19 -year -old boy could interrupt or think and that it is excluded that he shot accidentally.
The 19-year-old is also convicted of attempted murder on two occasions, preparation for murder, serious weapons crime in two cases, human trafficking, grossly illegal threats and abuse.
The judgment encompasses another defendant who is convicted of gross protection of criminal for being involved in washing a bicycle with connection to the murder. The penalty for that person is determined for youth surveillance for seven months.
