The HJC accepts the request, Judge Arta Lazari to be dismissed from office
The High Judicial Council partially accepted the request of the High Inspector of Justice for disciplinary proceedings against the magistrate Arta Lazari, a judge at the Court of First Instance of General Jurisdiction Shkodra, setting the measure « Suspension for 6 months ».
The High Inspector of Justice had proposed to the Supreme Council the disciplinary measure « dismissal » for the Magistrate A. LL., For actions/omissions that constitute non -fulfillment of duty, in violation of civil and criminal procedural deadlines, as well as non -moving, excess of civil matters. The ILD disciplinary investigation of the Magistrate has launched based on 11 complaints filed with allegations of non -fulfillment of duty, violations of civil and criminal procedural deadlines. During this investigation, HIDD inspectors identified other facts that have been added to the investigation launched.
In many cases from the registration of cases and their assignment, no action has been identified for a period of about 3 years. About 64% of the civil issues of the foundation for 2021 and 90% for the years 2022 and 2023 are exceeding the legal term of reasoning/submission (decisions of the type mainly the legal fact for recognition of truthfulness and solution of marriage, property or division of property.
The report of the investigation underlines that adherence to the deadlines of trial and reasoning are of fundamental importance for guaranteeing the right to due process and in particular the reasonable deadline. Such delays undermine entities’ right to due process, violating the right to make a reasoned decision and appeal, significantly damaging the image of justice and the public’s trust in it.
The actions of the judge have been carried out at least negligent in the form of negligence, repeated and continuous, and in some cases have caused damage to the investigative procedures. The judge has significantly damaged the image of justice and the public confidence in it, although there are 24 years of experience, indicative of a very good knowledge of duty with discipline.
From the investigation based on the voluminous materials administered and reviewed, the High Inspector of Justice concluded that the actions/omissions taken by the judge constitute « very serious disciplinary violations », provided by Article 102, point 1, letter « d » and « dh » of the Law « On Status » and proposed the Supreme Council. LL, a request that was partially accepted by the High Judicial Council, which imposed a different measure for the judge, that of suspension for 6 months.
