The Government sees a conviction to the prosecutor and will support it until the end with the endorsement of its partners | Spain

The time for the final battle between the Government and the Supreme Court around the most sensitive fuse came, that of the State Attorney General, Álvaro García Ortiz. Since the Executive launched the Amnesty Law, and even before, with the pardons and changes in the crime of sedition and embezzlement, the government and the Supreme Court have collided many times. The Criminal Chamber, directed by Manuel Marchena, to which some members of the Government consider almost a kind of shade opposition head, has given the Executive very hard. But now comes the time of truth: the decision to judge and in his case condemn the State Attorney General, something that in the Executive they see “completely impossible” because, as it is clear according to his vision in the car of Judge Hurtado, “there is no evidence” that Garcia was the author of the filtration of the mail in which Isabel Díaz’s lawyer Díaz Ayuso recognized two crimes and offered an agreement.

The government has decided to close ranks with the prosecutor even the day of which It has been one step away from the bench, But it is not alone: ​​most of the executive members also went out to support them and some criticized the judge who has decided to process it. Unlike other occasions, the Executive can count this time with the support of all the majority that supports it, including Podemos, lately very critical, because all coincide with different words in rejecting the judge’s car. Antonio Maíllo, from IU, saw him as an attack on the coalition government, while Ione Belarra, of Podemos, insisted that it is proof that justice continues to send the right. The Government has several judicial reforms in progress and hopes to have the support of all its partners. The PP and Vox, on the contrary, requested the resignation of the prosecutor.

The president, Pedro Sánchez, and his team of maximum confidence, with Félix Bolaños, Minister of Justice, at the head of this issue, are willing to maintain support to Garcia until the end, according to various sources of the Executive. But they trust not having to get to the point of supporting a convicted attorney general because they believe that in this case the one who has exceeded is stolen, with A car that provokes very thick words private by members of the Government. Executive members who are more on this matter believe that there is a conviction and even trusts that the appeal that García Ortiz will succeed because they will have to decide on it three magistrates with prestige. « Some judges are not aware of the deterioration of the image of justice that cause cars like today. Distrust in justice is growing. We see it in the polls. But we trust that when this reaches the Second Chamber of the Supreme Court there are others that do believe it is necessary to preserve that image of justice, » says a government member. « All these excesses will end up putting against them, if it is not happening anymore, » says another.

Since the right was made with the control of the CGPJ, more than 10 years ago, and even before, the Criminal Chamber has been filled with conservative judges until it is very decompensated in favor of this sector. But, even so, several members of the government consulted trust that these judges, already gathered in the form of a room and in need of consensus, « will not have the impudence » of condemning without evidence, according to the vision of the Executive, nothing less than a State Attorney General.

Sources from the State Attorney General’s Office explain that Álvaro García Ortiz was in the office of the president of the CGPJ, Isabel Perelló, with the authorities that were arriving at an act on equality, when the judicial decision that leaves him on the edge of the bench was known.
