The government introduces uniform rules for the creation and elimination of ANO with state participation

The White House expands the reform of management of its structures: from this year, uniform rules for creating, monitoring and abolition of autonomous non -profit organizations (ANO) with state participation will appear. Gorges create them for the implementation of national projects and state programs and distribute budget support for markets through them, but there is no data on this segment, as well as regulations for working with it, which creates the risks of inappropriate and inefficient expenses and loss of control over organizations. The new Modeling Model repeats the approach to state -owned companies – earlier in parallel with the digitalization of their work, the government revised the performance indicators of the Gosao and increased control over the expenditure of targeted state editing.

The government introduces uniform rules for the creation and liquidation of autonomous non -profit organizations with state -possession, follows from the Decree of the Government No. 440 of April 7. Until now, the law demanded that the state bodies register only the procedure for the participation of officials in the governing bodies of non -profit organizations.

As a rule, state dealers create an ANO for the implementation of individual projects in the framework of national projects, state programs or industry activities. Since ANO is not state institutions, they work more flexible, they can attract extrabudgetary financing, quickly purchase and sign contracts, hire employees on market conditions – this, for example, allows you to use the services of specialists who cannot be arranged in state bodies due to formal requirements or rigidity of the tariff mesh in civil service. Also, ANO may include private companies, universities, associations, which facilitates public-private partnerships, such organizations can provide services and conduct business activities, but the income received should go to the targets provided for by the constituent documents.

At the same time, non -profit organizations are a large channel for the distribution of budget funds, which requires increased control, and the government does not have data on the state of the entire ANO segment, and only from this year such NPOs are subject to accounting: in the Kommersant’s ministe, they reported that the list of Gosano is still being formed.

According to the resolution signed by Mikhail Mishustin, the status of decisions on the creation of ANO with state participation will be increased: the government will adopt them after the initiator coordinates the proposal with the Ministry of Justice and the Ministry of Finance and justify the feasibility of creating ANO. For organizations that are created by decision of the Government together with other legal entities or individuals, a typical charter is introduced in which there should be data on the structure and competence of the ANO governing bodies, the provisions on the responsibility of the head and key performance indicators that will have to be agreed upon annually with the industry department – this is necessary to maintain the control of the authorized goals of the ANO and the tasks set for them.

In the apparatus of the Deputy Prime Minister, the heads of the White House apparatus, Dmitry Grigorenko, explain that increasing control over the activities of ANO is the continuation of work to improve the public administration system. “Previously, the emphasis was on increasing the transparency and efficiency of state -owned companies, now similar principles apply to structures that receive state funding in extra -budgetary form. A de facto approach to asset management becomes unified and non-discriminatory in legal form, ”they say.

Earlier, the White House, we recall, significantly rebuilt the state control system: in three years, the collection of detailed data on their work has been deployed (see “Kommersant” dated 24 January, 2023), including information on the payment of dividends and on the use of the remaining profit. These data are already immersed in the system of dynamic monitoring GAS “Management”, which automatically corrects the requirements of state -owned companies in achieving cache and structural restructuring of the economy. The government tied to new key indicators of the effectiveness of Gosao and the system of rewarding the management of state -owned companies (See “Kommersant” of November 21, 2022), and from 2026, it will also strengthen the control over the subsidies and grants translated through state -owned companies to fulfill the state -proofs set before them (See “Kommersant” from April 3).
