The first session of Kosovo Parliament, Albin Kurti fails, cannot make a government. Kosovo needs sustainable governance
The constituent session of the Assembly of Kosovo was interrupted, as the majority of MPs did not vote for the report of the commission for verification of seats. This situation has not happened before in Kosovo’s legislative history.
The Vetevendosje Movement, which first came out in the election, has provided 48 seats in the Assembly, but has not yet announced the name of its nominee for the post of parliamentary parliament. He has also not announced whether he has managed to secure the necessary votes for the formation of the government.
Following the voting of the commission report on the verification of the seats, the leader of the session, the oldest MP Avi Dehari, said he would turn to Kosovo President Vjosa Osmani on how to further act.
Charges and counterclaims
The leader of the Democratic Party of Kosovo, Memli Krasniqi, said his party, which has 24 seats, did not vote for the report as he said he was « unconstitutional ».
« The Constitution clearly states that you cannot be prime minister and minister when you are an MP, » Krasniqi said, referring to Prime Minister Albin Kurti’s formal retardation. LDK leader Lumir Abdixhiku, who said after disapproving the report, said the session on the Constitution of the Assembly to be called as soon as possible, while saying that the Ruling Party, the Vetevendosje Movement, « is deliberately blocking the process ».
« This is a dark episode in parliamentary democracy. The LDK supports MPs who are only MPs and have no other functions. You cannot be both MPs and Prime Minister and Minister. We saw at the session, 52 supporters of a party claiming to have the numbers.
In office, Albin Kurti, for his part, accused the opposition political parties of « institutional attack ».
« They rebelled against the oath of the MPs and the constitution of the ninth legislature. This is an institutional attack against the Republic of Kosovo and the democratic elections. This is an unprecedented situation in our state and far beyond. We govern well, they leave the news of our state. That they are against the Government and the Republic are known today.
How will it be done?
For now it is a vague situation of how it will be further acted. At today’s constituent session, the MPs, after approval of the report, would take the oath and elect the chairman and vice presidents elected with at least 61 votes out of 120 countries as the Assembly of Kosovo. Then, at a next session, the Government of Kosovo was expected to be elected.
Albin Kurti’s Vetevendosje Movement, which came out the winning party of the elections, must also secure at least 61 votes to get a third term in charge of the executive. So far the Vetevendosje Movement has provided 48 seats in the Assembly, has not yet announced the name of its nominee for the post of Parliament Speaker, as it has not officially announced whether it has managed to secure the necessary votes for its election and the government led by Albin Kurti.
The LVV had earlier stated that it preferred to create new institutions with non-Serb communities, but has admitted in recent days that it needs cooperation with Albanian parties that have won seats in the Assembly so that it can form the government.
Coalition creation challenges
The three largest opposition parties have so far stated that they do not want to enter the coalition with the Self -Determination Movement of the Prime Minister, Albin Kurti.
Representatives of the Democratic Party of Kosovo, which has provided 24 seats in the Assembly, say they will not participate in the vote for the new parliamentary parliament during the Constitutional Session of the Assembly, without a « sustainable solution for Kosovo ». The Democratic League of Kosovo, which has 20 MPs in the Assembly, did not specify whether the proposal of the Vetevendosje Movement will vote for the Parliament Speaker, but said that any person who does not have 61 votes should not become Speaker of the Assembly of Kosovo. From the Alliance for the Future of Kosovo, which together with its partner in the coalition, the Social Democratic Initiative, have eight MPs in the Assembly, have stated that « in principle, they will vote for the new parliamentary parliament », proposed by the winning party, the Vetevendosje Movement.
Kosovo needs a stable government
International authorities have asked the political class in Kosovo to create the new government as soon as possible. Among them, German Ambassador to Kosovo, Joern Rohde, says Kosovo needs a sustainable government.
« The most important thing is to have a sustainable government with a good majority and consensus to form the new government, » Rohde told local media, adding that in these unstable geopolitical times, « what is in the interest of countries and peoples is to have sustainable government. »
But how are the procedures for the formation of new institutions foresee? According to the Kosovo Constitution, the post of Speaker of Parliament belongs to the first party that came to the election, in this case the LVV, while the largest political parties propose a candidate for vice president, but also MPs from the Serbian community and those of non-communities must propose from a deputy for the post of vice president. The chairman and vice presidents are elected by a majority of votes and constituent sessions, according to the Assembly Regulation, ends with their election.
Procedure for the formation of the new government
With the constitution of the Assembly of Kosovo, the path to the formation of the new government opens. Following the constitution of the Assembly and the Presidency, President Vjosa Osmani, according to the laws, is forced to nominate the winning party as a mandate for the formation of the new government. The proposed government cabinet must provide at least the votes of 61 deputies out of 120 deputies as the Assembly of Kosovo has. The Vetevendosje Movement, with the 48 seats secured in the elections, must definitely enter into a coalition with another party so that it can form the government. If the Vetevendosje Movement fails to secure the support of 61 MPs, then President Osmani is obliged to invite political parties within ten days. After consultations it is at its discretion to decide on the new mandate if it proves it has numbers to form the executive. The new mandate then has 15 days for the Assembly to the Assembly the composition of the cabinet. But if the government is not formed even after the second attempt, then President Vjosa Osmani, according to Article 95 of the Constitution, must declare new elections, which should be held no later than 40 days.
