The European Court of Justice forces Sweden to try the spermary thefts
The sperm scandal in Halland was revealed when SVT’s assignment review in 2022 was able to show that at least five men became sperm donors against their will. They came to the care of the 80s and 90s to investigate their own childlessness, but their sperm were used for other inseminations.
The events have been investigated and in The hospital’s own report States that the then fertility clinic acted illegally: « The business was conducted in violation of laws and guidelines ». However, all cases have been deemed to be prescribed.
But two men took their cases to the European Court of Justice and Now a judgment has been offered in support of them.
– The European Court’s decision is a clear signal to Sweden that violations of human rights must not be prescribed before knowing that one’s rights have been violated. Now the case must be tried by Swedish courts, says Alexander Ottosson, representative for the two pilot cases.
One of them is called Bengt Wernersson and lives in Halmstad.
– It is good that they have to admit what has happened and nice that it is not possible to hide, he says.
In his own case have the revelation of the involuntary sperm donation led to a warm relationship with it previously unknown biological daughter Rebecka And her family, but he knows that others have been terribly ill.
– It is a perfect personal disaster for some, says Bengt Wernersson.
The center for justice that has driven the cases in the European Court of Justice will now sue Region Halland in a Swedish court and claim damages in the order of SEK 100,000 per person.
– We start with the two men who have been our pilot cases, but that goal is obviously precedent for everyone affected, says Alexander Ottosson.
DN is looking for Region Halland for a comment.
