On July 9, the European Court of Human Rights will announce a decision in the case of Ukraine and the Netherlands against Russia regarding serious violations of human rights in the temporarily occupied territories of Donbass and during the full -scale war of Russia against Ukraine.

Details: The European Court of Justice announced that on July 9, the Court would announce the decision of the Grand Chamber in the Interstate case « Ukraine and the Netherlands against Russia ». This interstate case concerns the complaints related to Russia’s military actions in Ukraine, which lasted from February 24, 2022, as well as an armed conflict in eastern Ukraine, which began in 2014, including the failure of the MH17 flight.

On Facebook, the ECtHR Commissioner Margarita Sokorenko stressed that it was a legal confrontation with Ukraine with an aggressor state, in which the Ministry of Justice team has worked continuously for many years.
« In today’s form, the case brings together four statements about flashy human rights violations in Ukraine, » she said.
According to Sokorenko, they enter there:
- Ukraine against Russia (No. 8019/16) – violations during the armed conflict in the Donbass, in particular the killing of MH17, torture, forced labor and more;
- Ukraine against Russia (No. 43800/14) – abduction and illegal movement of Ukrainian children to the Russian Federation in 2014;
- The Netherlands against Russia (No. 28525/20) – the circumstances and consequences of beating MH17 flight;
- Ukraine against Russia (No. 11055/22) – gross violations of human rights during a full -scale invasion from February 24, 2022.
Sokorenko reminded that in January 2023 the ECtHR had already declared a partially acceptable case on three first statements, establishing that the Russian Federation has controlled the occupied Donbass regions since May 11, 2014.
In February 2023, the application for invasion (No. 11055/22) was combined with the main case.
This case is unprecedented: 26 states and one international organization as third parties have joined it.
« The expected decision will be fundamental – not only for legal practice, but also for all victims of aggression of the Russian Federation. It is a matter of global justice and the voice of truth in the post of truth, » Sokorenko stressed.
Prehistory:
- Since 2022, Russia has stopped participating in the ECtHR proceedings despite the fact that it is still responsible for the decisions on the complaints filed by September 2022.
