Prosecutors achieved in court the cancellation of a sentence in the form of a fine for the former head of the Brovarsky district state administration Volodymyr Maybozhenko, who in a drunken manner at the wheel of the car committed four pedestrians.

Details: Juvenile prosecutors of the Kyiv Regional Prosecutor’s Office filed an appropriate complaint with the Kyiv Court of Appeal, and he granted it, appointing a new hearing in the court of first instance.

The appeal concerned the sentence of the Brovarsky City Court, which he approved the reconciliation agreement and appointed the exchanging of the Brovarsk RDA a penalty in the form of a fine of 34 thousand UAH with deprivation of the right to drive vehicles for 3 years.

That preceded: On April 26, 2024 in Brovary, while driving the car, Maybozhenko traveled to the forbidden traffic signal, left on the sidelines and hit four pedestrians, including one child. The victims were hospitalized.

According to the results of testing the Drager device, the driver was determined by the content of alcohol 2.31 ppm.

In January 2025, the Brovarsky District Court recognized Maybozhenko guilty of an accident in a state of alcohol intoxication and fined. The Court approved the reconciliation agreement between the accused and the victims.

The Kyiv Regional Prosecutor’s Office reported that they would challenge the court. They stated the impossibility of concluding an agreement on reconciliation in such proceedings, because they are contrary to the public interests and requirements of the Criminal Code, because the penalty provided for the penalty agreement does not meet the sanctions of the article. The prosecutor’s office also emphasized the lack of grounds for mitigation.
