The court sentenced the case of fraud with lands in the Ramensky district of the Moscow Region
In the Moscow region, a group of scammers who stole with the help of false documents from state property a land of land with a market value of more than 100 million rubles was sentenced. The defendants received from conditional punishment to five years in the colony. As it became known to Kommersant, the Voskresensky City Court of the Moscow Region sentenced four defendants in a criminal case of particularly large fraud (part 4 of article 159 of the Criminal Code of the Russian Federation) with lands in the Ramensky district of the Moscow Region. The maximum term-five years of colony of general regime-received 47-year-old legal adviser to Stroytekhnadzor LLC Yuri Kislitsyn, whom the investigation and the court considered the organizer of the scam. The general director of LLC Protection, Anatoly Litvinenko and manager of this company Mikhail Trushkin, involved in the criminal group, were sentenced to four and three years in prison, respectively. An employee of TD Alegra LLC Andrei Zharkin escaped with a conditional term. He was the only person who fully pleaded guilt. Two more people, including the former cadastral engineer, died during the investigation and court.
Investigation of the circumstances of the disappearance of land owned by the state in the area of the village of Ostrovtsy, the police near Moscow began in February 2022. It should be noted that in November 2021, the deputy of the Moscow Regional Duma Igor Chistyukhin appealed with a statement about possible frauds to law enforcement agencies.
As the investigation established with which the court agreed, Yuri Kislitsyn developed the criminal scheme “no later than December 2020. The lands of the former state farms “Podomskovo” and “Safonovsky”, as well as the Nikonovskoye Plant, Ramensky district of the Moscow Region, fell into the sphere of interests of the fraud. In 1992, almost 8 thousand hectares belonging to these agricultural enterprises were provided free of charge.
The case states that lands were « unlimited state property, the disposal of which, by virtue of the law, was carried out by municipal education. »
Participants in the criminal group, the investigation materials said, established owners of shares or their relatives, made fake contracts for the sale of land plots to their names, and also issued the technical conclusions of the cadastral engineer. The latter indicated the coordinates of the boundaries of land with obviously false conclusions about the right to inherit plots.
After preparing a package of linden documents, the frauds filed a lawsuit to the Ramensky city court on the transfer of ownership of land. They, in particular, indicated that in 2016 the plots were allegedly sold to the new owners, but the previous owners, under various pretexts, refuse to renew them. At the same time, in court, as the investigation and the court established, the plaintiffs and defendants, controlled by the participants of the criminal group, acted in the same case.
All claims regarding the land was considered and satisfied by the same judge of the Ramensky City Court – Elena Arkaeva. Subsequently, her decisions were canceled by the higher authorities as illegal, and Mrs. Arkaeva herself lost her position in 2022. The Kommersant source claims that now an audit is being conducted on the fact of a possible make of deliberately unfinished decisions (Article 305 of the Criminal Code of the Russian Federation).
After the court decision entered into force, the attackers could only register in Rosreestr the right of ownership of land in their name.
In total, according to the estimates of the investigating authorities, from December 2020 to March 2021, using false documents, the defendants re -registered land plots with a total area of about 77 thousand square meters. m.
The damage caused by the defendants amounted to more than 100 million rubles.
The defense of Yuri Kislitsyn, who only partially pleaded guilty, told Kommersant that she filed an appeal against a sentence in a higher court, abandoning more detailed comments.
The lawyer of the Borodin and Partners Lawyer Alexander Dvoryankov, representing the interests of Andrei Zharkin, told Kommersant that her client was satisfied with the Voskresensky City Court. “The court took into account all the mitigating circumstances, as well as its role in the perfect crime and sincere repentance. Given the severity of the article by the Criminal Code, my client considers the verdict fair, ”Mrs. Dvoryankova explained.
