The Podarnusky district court sentenced two teenagers to almost ten years in prison for beating to the death of a 59-year-old man in the volost of Tori Povarno district at the end of summer last year.

The court found adolescents guilty of intentional murder, perfectly with a painful and cruel way, and sentenced them to nine years and six months in prison, BNS reports. The deadline for serving the sentence is counted from August 26 last year.

In addition, young people will have to pay the state a fine of 2215 euros.

15 and 16-year-old teenagers at 4 a.m. on August 25, under the influence of a mixture of alcohol and drugs, penetrated the house of a 59-year-old local resident in the village of Tammista Volosti Tori and beat him to death in a particularly painful and cruel way.

According to the prosecution, the adolescents inflicted at least 50 strokes to the man and subjected him to various humiliations. During the beating, they shot part of their actions with the help of the phone. The video was mounted and sent to contacts on a social network, through which video recording became the property of the general public.

One of the subjects of the dispute in the court investigation was the number of specific strokes inflicted by one or another defendant. The district court came to the conclusion that the contribution of adolescents to violence, both painful and cruel, was equal. The version of the defense that all the strikes were visible on the video viewed in the court and that no more strokes were inflicted than on the video does not correspond to the totality of the evidence studied.

The court did not agree with the defense that the actions should be qualified under an easier article. At first, the teenagers intended to beat the victim, but at the crime scene in the victim’s house, their intentions grew due to the mass continuation of violence into a joint intent, which is required to determine the crime as an intentional murder. The teenagers admitted and realized that they crossed the “red line” and considered the death of the victim possible.

The law provides for 8 to 10 years in prison when condemning minors for intentional murder. The court concluded that the guilt of young people can be described in different ways, but the severity of crimes is the same, and therefore they should be sentenced to the same punishment. As a mitigating circumstances, the court takes into account remorse expressed by adolescents in a minimal and partial form, taking into account the ability of adolescents to understand.
