Tartusky County Court with his decision on Monday satisfied the appeal filed by the lawyers by Steve-Khristus Evestus and Arthur Knyazev on behalf of the Estonian Orthodox Church of the Moscow Patriarchate (EPCMP) for the resolution of the registration department to register the new version of the EPCMP charter and the ESCMP under the new name Estonian Christian Orthodox church.

The registrar considered this name misleading, since it mistakenly includes all Orthodox believers in Estonia. On the other hand, the registrar did not reveal any other shortcomings in the MPEQ application for registration in its charter, BNS reports with reference to the court decision.

In accordance with the decree, the new name complies with the law and does not mislead regarding the goal, sphere or legal form of the church.

The court considered the plaintiff’s explanations appropriate and understandable that the new name correctly indicates the purpose and sphere of the church – it is a Christian Orthodox Church operating in Estonia.

According to the court, in the context of freedom of religion, one cannot conclude that any church can cover all believers. The conclusions of the court are final and obligatory for the registration department, which should be guided by them when repeated consideration of the EPC MP on registration.

“Our Church emphasizes its self -governing status with the new name and the charter. Over the past year, we had to endure the attitude towards us because of our canonical ties with the Moscow Patriarchate, from which the name of our church came. The new name and the charter reflect our independence in church-administrative ones-economic, religious and civil matters, ”said Bishop Daniel.

On September 19 last year, the EPC MP submitted an application for a change in the charter and name to the registration department and asked for its new name to be the Estonian Orthodox Church. The registration department transferred the application for permission to the judge, who considered the name of the Estonian Orthodox Church to misleading and unacceptable, since it, according to its assessment, was misleading, since it could cover all the Orthodox believers in Estonia.

Then the EPC MP chose a new name – the Estonian Christian Orthodox Church, but for the same reasons, the registration department considered this name misleading. Representatives of the EPC MP challenged this decision of the registration department and the court decision on this issue is final and entered into force.
