The court abolished the permission to build a house in Lviv

The Supreme Court overturned the decision of the executive committee of the Lviv City Council, which allowed the construction of an apartment building on Ternopil Street, 42 in Lviv.

Such a ruling court accepted May 1 in the case of a lawsuit of the residents of the neighboring house. The Supreme Court’s ruling is final, it has already come into force and cannot be appealed.

The construction of the Terminal – LTD, which belongs to the Lviv Michael Milyan, was engaged in construction.

The relevant town planning conditions and restrictions (MUO) for the company « Terminal-LTD » was approved by the executive committee of the Lviv City Council in 2021. At the same time construction began.

It was planned to build a dwelling house on 6 and 8 floors (63 apartments with two commercial structures).

In April 2022, the residents of the neighboring house went to court with a lawsuit against the executive committee of the City Council and LLC Terminal-LTD.

They demanded the abolition of the MUO issued, as the construction of a new high -rise building violated, in particular, state building codes regarding the permissible density of the population and distances to neighboring homes.

The trial lasted more than three years, the case reached the Supreme Court twice, but in the end, the residents achieved their own.

It was first reached the Supreme Court in 2023, but in 2024 he sent her to a new hearing in the Court of Appeal. For the second time, the Supreme Court began to hear the case in February 2025 and in May decided to cancel the decision of the executive committee on the approval of the MUO.

According to the Supreme Court’s opinion, the intention of building the site did not meet the requirements of the master plan of Lviv, and therefore the executive committee of the City Council had no right to issue the MUO for such construction.

Meanwhile, as long as the litigation continued, the two -section high -rise building has already been erected, and on the LUN website it is stated that all the apartments in the still unfinished house have already been sold.
