The Civil Guard has concluded that the hiring process of 85 people for the extinct Andalusian Foundation for Training and Employment (Faffe) – a public entity of the Board created by the previous socialist governments and that is being investigated in the courts for plugging and fraudulent use of public money – was irregular. The majority of these workers were relatives of members of the PSOE, of former high positions of the Junta de Andalucía, trade unionists or members of business organizations, among which is the wife of the PSOE spokeswoman in the Senate and former secretary general of the Andalusian socialists, Juan Espadas.

In your report, prepared at the request of Judge José Ignacio Vilaplana that investigates the cause and that has been advanced by Diario de Sevillathe Central Operational Unit (UCO) of the Civil Guard maintains that these 85 hiring « would have been carried out without adjusting to the regulations in force at the time of formalization, violating the normative principles of equality, merit, capacity and advertising that must be governed in public procurement, being able to infer that they have been carried out arbitrarily. »

The researchers point out how some of these contracts were signed without any selection process and others, although the set procedure was initiated, they developed without “adjusting to the regulations in force at the time of their formalization, presenting several irregularities in the different phases”. Thus, in most hiring the internal basis of the Foundation “to the detriment of the advertising requirement legally marked, since using only that internal base could be greatly reducing the scope of the job offer”. The UCO also highlights the absence of scaling criteria with which the pre -selection of the candidates was carried out, a procedure, however, which was also omitted in any of the cases analyzed.

In the cases in which this previous scale was carried out, the agents emphasize that, finally, only the personal interview « to which the person who would be hired would be hired was decisive. » A personal interview that, in general, was « the only proof to which he underwent the future worker, proof to which only the person who was subsequently hired, » according to the report.

Among the contracts investigated is that of Carmen Ibanco, the woman of swords, who accepted her right not to declare when she was interrogated by the UCO. The researchers argue that « not only would it have been a beneficiary of a hiring that would not have adjusted to current regulations, but would also have benefited from a promotion in its labor category, with the corresponding salary improvement, without having carried out the corresponding selection process. »

The position obtained by Ibanco, thanks to the suitability of the personal interview, five other candidates were presented, although all ended up hired. These professional promotions without carrying a selection process is an irregularity that researchers appreciate in other investigated hiring. Other facts that do not conform to law are the contracts of four workers who developed their functions not in Faffe, but as internal advisors of the Board of Employment; the workers who received monthly salary accessories from 193 to 440 euros, without being contemplated in the agreement; or the perpetuation over time, without modification or extension, of contracts by work or service with a duration, in most cases, less than six months.
