The case against Lena Borislavova may end with a fine
The case against MP Lena Borislavova from « We continue the change – Democratic Bulgaria » for the fact that she consciously used false documents before the Registry Agency would not end with a sentence, but with an administrative sanction – a fine if she was found guilty.
The Sofia District Court held a court hearing today in the Sofia District Court (CPC), but since Borislavova has a purely court past and the maximum punishment she can receive is 2 years in prison, the case will go through the administrative order. No pecuniary damage has occurred from the crime he has been charged with, and therefore the punishment, if convicted, will be a fine.
Shortly before, lawyer Daniela Dokovska, who represents Borislavova, requested the indictment to be returned to the prosecutor’s office for material violations – the investigation against her began before she abandoned her immunity, which was in violation of the constitutional provisions. Thus, in practice, according to Dokovska, unfit evidence was collected – interrogations of witnesses, eye rate and accepted conclusion of computer expertise.
Borislavova has been charged with a document crime committed in 2021, upon release of the leader of « Continuing the change » Kiril Petkov from the Association « Let’s Keep Coral ». The investigation came after a signal from the chairman of the association Atanas Rusev, who claims that in 2021 the prosecutor’s office claims that Borislavova had presented to the Registry Agency the power of attorney and other documents with his forged signature.
It is a power of attorney on his behalf, as well as a protocol of a meeting of the Association, and the aim was to release Kiril Petkov as a member of the Board of Directors of « Keep Coral » in order to become Minister of Economy in the first official government of Rumen Radev.
At the end of last year, I.F. Prosecutor General Borislav Sarafov demanded the immunity of Borislavova, and she gave up his voluntarily a month later – at the end of January.

The prosecutor’s office said the prosecution was that, in the conditions of a continued crime with two acts, Borislavova was consciously used by false private documents, to which the signatures were given to them by members of the Association « Keep Coral ».
Borislavova was drawn to criminal liability for the fact that on May 13, 2021, at about 1:55 am, before an official at the Registry Agency in Sofia, she was deliberately enjoyed by false private documents – a declaration under Art. 13, para. 4 of the Commercial Register Act and the register of non -profit legal entities; List of all members of the Non -Profit Association « Keep Coral » as of May 6, 2021; Protocol on the foaming of an invitation to convene a general meeting of « Keep Coral », association, as of April 20, 2021.

Borislavova also used a power of attorney, which authorized herself, to which she was given the appearance that the signature of the document was placed by Rusev and was not indeed posted by him, the prosecutor’s office said in the indictment.
On May 14, 2021, at about 11.45 pm, Borislavova was consciously used by the following false documents at the Registry Agency: a list of all members of the non -profit association « to keep coral »; A list of all members of the association attended at the General Assembly held on May 6, 2021; List of all members of the Non -Profit Association « To Reserve Coral » as of April 19, 2021 and a protocol of the meeting of the Management Board of the Association « To Reserve Coral », to which the signatures of the documents were affixed by the chairman of the Board of Directors and of Reality.
Borislavova again used the power of attorney, which she presented the previous day. It was deliberately used by the false documents, and they were used to prove that the legal attitude between Kiril Petkov and the « Coral » Association was terminated, and no criminal responsibility could be sought for the drafting of the documents, the prosecutor’s office said.
During the meeting, it was learned that witnesses had been questioned in the case, eye rates were conducted and expertise was appointed. If the court’s decision is upheld by the Sofia City Court (Sofia City Court), the case against Borislavova will continue in June with the interrogation of witnesses.
