Due to a ruling from the Constitutional Court, about ten thousand self -employed people are in danger of having to repay thousands of euros to Corona Sun. Entrepreneurial organization UNIZO reported this on Thursday.
The Court bowed on Thursday about the bridging right that was introduced during the Coronapandemie for the self -employed. A higher benefit amount was provided for those who also charged children, which was subsequently checked on the basis of the data from health insurance.
After all, the supplement was only intended for entrepreneurs at whose health insurance fund one or more children were registered as persons, and not for entrepreneurs whose children are registered with the health insurance fund of a former partner. The supplement was therefore recovered from more than 38,000 self -employed persons at the end of 2022.

A number of entrepreneurs disputed the criterion, but the Court of Appeal did not infringe the constitution on Thursday and stated that the difference in treatment is based on an objective criterum and has no disproportionate consequences. UNIZO fears that the federal government may now continue with the recovery of the supplement with more than 10,000 entrepreneurs. The average amount is 3,330 euros.
According to Unizo, it was not clear at the time of the application that the children had to be registered in the name of the entrepreneur at the health insurance fund and the vast majority of applicants acted in good faith. The organization advises them to request a remission. More than 3,500 entrepreneurs already did that, and two thirds received at least a partial cancellation.

“If 38,000 entrepreneurs made the same 'error', and the RSVZ (National Institute for the Social Insurance of the Self -Employed, ed) In two thirds of the things that already occurred the debt, something clearly went wrong. Real fraud must be tackled, but that is clearly not this, « says Deputy Director Frank Socquet of the study service.
