Superior Council of Judiciary issues clarification on violation in Loures
The Superior Council of the Judiciary (CSM), at the request of the District of Lisbon Norte, issued a clarification note on the contours of the case of violation of a young woman in Loures and the dissemination of images of crime on social networks.
« The first judicial interrogation of argued defendant does not correspond to a judgment of the facts, nor is the anticipation of the application of penalties, with the end, only the application of coercion measures designed to protect the dangers referred to in Article 204 of the Criminal Procedure Code, » reads examples of these dangers.
« Escape or danger of escape, danger of disturbance of the inquiry or instruction of the proceedings, danger for the acquisition, conservation or veracity of the evidence or even danger, due to the nature and circumstances of the defendant’s crime or personality, that it continues criminal activity or severely disturbs public order and tranquility. »
According to the CSM, the coercion measures applied were those that had been requested by the prosecutor, who deduced the prosecution against the three defendants concerned.
« After interrogation and in accordance with the evidence available, the defendants were submitted, by decision of the Criminal Instruction Court, to the non -private coercion measures that were promoted by the Public Prosecution Service, » said the CSM in the same note.
« These measures were considered, in view of the elements available in the file, proportional and appropriate to the precautionary purposes that aim to ensure, pursuant to articles 191, 192 and 193 of the same code, » he reads.
It is recalled that the three young people are subject to weekly presentations at a police station in the area of their residence; prohibited from contacting the victim by any means, including social networks and through a person; and forced not to approach less than 50 meters from the offended; They are also prohibited from bringing less than 500 meters closer to the house where they reside or otherwise resides, as well as the school that frequently.
The fact that the three defendants did not have been subject to non -deprivation of liberty measures generated indignation in society.
The Portuguese Platform for Women’s Rights promoted a open lettersubscribed by more than 70 organizations and close to 3,000 people, asking for « concrete measures for the accountability of suspects, digital platforms and the judicial system. »
The CSM also recalled that the case is under secret justice and that the investigation continues its legal terms and that the court decision is subject to appeal.
The note ends with a reminder: « It should be noted that judges/judges decide independently and impartially, based on the elements contained in the case file and the rigorous compliance with the law. »
