Son of Montenegro has already delivered Spinumviva documents to PGR
The Attorney General’s Office (PGR) confirmed Sunrise That the documentation of Spinumviva’s activity, the company Luís Montenegro founded in January 2021, along with his wife and children, is already joining the preventive investigation opened by the Public Prosecution Service.
The investigation runs in the Central Department of Research and Criminal Action (DCIAP), a specialized PGR body and with the competence of investigating complex economic and financial crime at national level.
If it is considered that there are facts indicating crime, the inquiry will have to pass to the Public Prosecution Service, with the Supreme Court, since acts performed by the Prime Minister are concerned.
It was the son of the head of government, Hugo Montenegro, managing partner of Spinumviva since late February, who delivered the documentation. The information was advanced by the Sunrisenot wanting to provide additional clarifications.
Preventive or inquiry-crime inquiry?
It is recalled that PGR had announced on March 12 the opening of «A preventive investigation to the data, to collect additional elements in relation to third entities»following three complaints – one presented by former ambassador Ana Gomes.
At the time, the Attorney General of the Republic, Amadeu Guerra, explained that the investigation would not resort to «Intrusative MEANS» -such as listening or breach of bank or tax secrecy, which could only be authorized by a judge in the context of a criminal inquiry-but the collection of data in «Open source and requests to third parties, which may or may not provide the information» requested by the Public Prosecution Service.
Given the suspicions participated, preventive investigation is intended to gather the accounting of Spinumviva and all companies related to their universe, so that the prosecutor can assess whether there are facts indicating a crime.
In March, Amadeu Guerra stated that the PGR was «Collect Elements» and that, from the information collected « So far there is no foundation to open any inquiry. »
The decision to open preventive investigation instead of a criminal inquiry limits the action of the DCIAP Attorney, who will not be able to access bank accounts or any documentation delivered by the company to the Tax Authority.
What is at stake
On the basis of the complaints are essentially two suspicions in relation to the Montenegro family business. One of the suspicions raised – the most serious – would even be an alleged corruption scheme, thesis raised mainly by PS leader Pedro Nuno Santos. According to this, Montenegro’s family business could be receiving high amounts for fictitious services.
In a statement published on February 28, the spinumviva guaranteed that « The prices charged and paid for the services provided meet the size and complexity of the work with each client and oscillate between the thousand and the monthly euros. » Solverde’s border was stipulated at the maximum value – 4,500 euros – which, according to the lawyers consulted by the newspaper Observer, «Don’t Hit», nor does «Almost daily monitoring of the activity» of the company.
There is yet another doubt that remains. Among the main clients of Spinumviva are Solverde, Popular Radio, Ferpint, Sofarma (Lopes Barata, Consulting and Management, LDA) and Clip – Luso International College of Porto, but continues without knowing the identity of spinumviva occasional customers, nor the specific value of billing of each client.
