Signa insolvency administrator is suing the republic to millions-Diepresse.com
Norbert Abel makes his threat come true and pulls against banks, auditors, insurers, former signa managers and foundations. Signa Prime’s mass administrator demands around 200 million euros.
It is a real round of complaints that is pushing on the commercial court. The insolvency administrator of Signa Prime, Norbert Abel, brought in 28 of them to claims to contest. Overall, it is about a sum of 199.6 million euros, which the creditors should benefit. This emerges from bankruptcy documents that are available to the « press ».
Signa Prime is probably the most important society in the insolvent Signa empire. The Hyatt Park and the Golden Quarter are subordinate to it and should be sold, As « Die Presse » reported. The sales process has already started for the real estate complex around the luxury hotel at the farm. According to the « press » information, there were already the first mandatory offers.
Ex-signa managers and auditors do not want to pay
« Numerous claims could be brought to an out -of -court settlement, » says the latest bankruptcy report. So 27 parties have already agreed on an out -of -court repayment. The total proceeds of these extrajudicial payments are 65.2 million euros. Abel had previously threatened to complain. For example, the auditing company KPMG paid around 819,000 euros on the bankruptcy account and the Landesbank Hessen-Thüringer Girozentrale 26.47 million euros. The Bayrische Landesbank also paid 2.1 million euros.
Two procedures with a minor amount in dispute were positively completed by complete repayment or comparison in favor of the mass. The mass loan was also completely repaid by Signa Prime to the British asset manager Attestor.
But others still defend themselves against a payment. Claims against ex-RBI boss and ex-signa supervisory board Karl Sevelda are legally pending. Also against ex-signa managers Timo Herzberg and Manuel Pirolt. And the auditing company TPA is also to be taken into account with 120,000 euros. Her top consultant Karin Fuhrmann had last left the executive floor.
Republic owes 23 million euros
Abel also demands 22.85 million euros from the Republic. The tax office for large businesses has so far rejected payment. In order to obtain an expert opinion, the conference statute was postponed for an indefinite period. The tax authority should have known that the real estate group was already bankrupt at the time. A most recent report says that Signa Prime was broke in March 2022. The company’s annual financial statements should have been known to the authority.
The list of star architect David Chipperfield, who designed the Hamburg Elbtower, is also on the list. The project is now a building ruin in the Nordic city. His construction stop had marked the end of the Signa success story. In addition to some banks and construction companies, foundations are also targeted by the insolvency administrator. The RAG Foundation is asked to pay 8.3 million euros.
René Benko demanded 300,000 euros
The insolvency administrator demands 15.2 million euros from the INGBE foundation named after René Benko’s mother. In addition, the legal ineffectiveness of the lien on the business shares of Signa Prime Assets GmbH and Signa Prime GmbH & Co OG was also asserted to the INGBE and Americia (the company also holds a share in the company of the Park Hyatt). A procedural concentration should keep process costs low and make the procedures efficient.
A declaratory action is also prepared against Signa founder René Benko himself. Abel demands 300,000 euros for Signa Prime in the bankruptcy procedure. In return, claims of 11.7 billion euros were reported to Signa Prime. So far, only 4.94 billion euros have been recognized. All of these complaints make up only a small part for around 200 million euros.
