Ryszard Cyba will not return to prison. Psychiatrist with possible scenarios
– I worked in a detention center in Szczecin for 31 years, not a few days or months. This is not anyone’s « vision », but a normal proceduredescribed exactly in the provisions of the Executive Penal Code – says Dr. Jerzy Pobocha and indicates three situations.

First possibility. When the convict directly threatens his health and life, and treatment cannot be carried out in the conditions of prison healthcare, he is requested to suspend his penalty. The court approves this based on the opinions of doctors.
Second situation. When a person shows such a great dementia that he does not understand where he is or why, his stay in prison loses its meaning. – The punishment has a rehabilitation and educational purpose and we can only talk about it when a person understands that he has done something wrong and for it is punished – indicates a psychiatrist.
The third premise – an auxiliary, but important from the point of view of a prison – occurs when a convicted person shows a permanent or difficult to remove mental disorders. With his behavior, for example, shouting and waking other prisoners at night, he can cause anxiety in the entire prison. What’s more, by disturbing the peace of others, at the same time she exposes himself to aggression on their part.
– For the sake of the safety of the person who can pay this with health or life, he must be removed from these prison conditions – explains the expert.
Cases such as Ryszard Cyabathat the convicted person has a suspended manner of a sentence due to health and progressive dementia, is very rare. This is primarily due to the fact that the elderly people are very little in prisons. In this particular situation, however, this was a normal procedure.
From the prison to the homeless shelter. « It was an act of despair »
As the Ministry of Justice revealed, the 76-year-old, convicted of murder, first stayed in the hospital ward for chronically ill patients in Czarno, and then-when the experts found him cognitive disorders and progressive dementia, which requires care in the DPS conditions-he was « directed » to the institution indicated by MOPS in Częstochowa medical.
– The fact that he went to the homeless shelter is such an act of despair from care services – says Dr. Jerzy Pobocha.
Ryszard Cyba was to brawl there, refuse to take medicine, so the staff notified the police and ambulance, which took him from there to a psychiatric hospital. Here Dr. Pobocha refers to the provisions of the Mental Health Act of 1994, which indicate that a person dangerous for himself and the environment can be admitted to a psychiatric hospital in an emergency.
– Later, the judge arrives within 48 hours of notification. He interrogates both this person and doctors, or witnesses, if they are, and issues a decision on forced treatment, i.e. a compulsory stay in a psychiatric hospital – explains the expert. The court may also make such a decision in the event that a sick person does not pose a threat, but promises improvement.
Does this mean that Ryszard Cyba is a threat to the environment?
« It is only a threat as every patient with Alzheimer, » says the expert psychiatrist.
– A person with this type of mental disorders is not capable of any planned, intended, intentional actions. She is not able to get a weapon or other dangerous tool in such a state or even select or even react to a specific person. However, she can show aggression as well as other patients with Alzheimer’s disease.
It is worth emphasizing that Alzheimer does not always mean attacks of aggression. This is not only influenced by the disease itself, but also the personality of man. If someone has already been inclined to aggresses, it may also be revealed in the disease.
Such people can hit, beat, spit or push a person from the immediate environment who looks after them, but – as the psychiatrist points out – this is random, reflexive, unintentional, it does not result from any deliberate actions.

Looking at the fact that Alzheimer is an incurable disease, doctors can only alleviate symptoms and slow down its progress, Ryszard Cyba will probably never return to prison. Currently, according to the Ministry of Justice, he is in a psychiatric hospital, but what will happen next?
As Dr. Jerzy Pobocha explains to us, a man can go to a psychiatric hospital, where this stay is shorter – up to about three months. The National Health Fund, as the expert explains, does not pay longer hospitalization. After that, he may find a ward for chronically ill, where he can stay further.
– Later it can be placed in a social welfare home for people with dementia, but if a person is aggressive, restless, dangerous, then such DPS has no conditions and staff to ensure their care. And then there is a problem where to put this person – admits Dr. Pobocha.
If the convicted person committed a new crime, being in the present state, he would be considered an insane person and the court could refer him to a psychiatric hospital. Here the situation is not so simple.
– Often such a person runs like a boomerang between psychiatric hospitals and social welfare homes. At this age, such things usually end, sooner or later, simply death – reveals an expert psychiatrist.
