Referendum 8 and 9 June: what is in the 5 questions and what can change if the yes wins
Sunday 8 and Monday 9 vote for the 5 repeal referendums in terms of work, safety and citizenship. The goal of the quorum (50% plus one of the entitled persons). What happens if the yes wins
Sunday 8 June (from 7 to 23) and Monday 9 June (from 7 to 15)
voters are called to vote on 5 repeal referendums: 4, promoted by
CGIL, on the subject of work (layoffs in large and small companies,
fixed -term contracts, contracts) and one, promoted by +Europe, on the requirements for the
Italian citizenship. THE results will be valid only if the
quorum, or if it has voted 50% plus one of those entitled. Those who vote yes, express themselves for the cancellation of the rules covered by the question, who votes no to keep them valid.
Green card – Jobs Act and illegitimate layoffs
The repeal of Legislative Decree 23 of 2015 is requested, one of the implementing measures of the Jobs Actwhich regulates the protections in case of illegitimate dismissal for workers hired after 7/3/2015
in companies with more than 15 employees.
If the yes wins: also to these would apply the valid rules for others
employees, or the Fornero law of 2012 which reformed article 18
of the 1970 workers’ statute, limiting the right to
reinstatement in the workplace, but in any case more than decree 23 which, as a rule, provides for compensation up to 36 months. However, they would drop to 24 in case of application of Fornero.
Orange card – allowances in small companies
The abolition of the rules that set a roof of six months for compensation in the event of illegitimate dismissal of workers of small businesses (up to 15 employees) and 14 months for those who work in companies with no more than 60 employees but divided into production units with a maximum of 15 employees.
If the yes wins: the judge could establish compensation higher than these
roofs. The laborists are divided on the amplitude of this discretion. For
Some compensation could not however exceed 24 or 36 months (according to the outcome of the first referendum) as in large companies.
Gray card – Causal for fixed -term contracts
The question aims to repeal article 19 of Legislative Decree 15 June 2015, n. 81 that governs the duration of term contracts without causal up to 12 months. At the moment, the law authorizes employers to hire with fixed -term contracts lasting up to 24 months, but a motivation is necessary only from 12 months upwards.
If the yes wins: In case of victory of the yes, also for fixed -term contracts lower than 12 months, companies must, from the first day, indicate the causals, as per the collective agreement. The objective of the promoters is to restrict the fixed -term work. The fear of the opposites is that companies take less.
Red card – Contracts and solidarity responsibilities
The question concerns the Solidarity responsibility for work safety. Today it exists between the client company and the company that receives the contract or subcontracting, except on the « Specific risks » of the activity of the latter. The repeal of article 26, paragraph 4, of Legislative Decree 9 April 2008, n. 81 which excludes precisely this responsibility in
solid in case of accident of the worker of the contractor or
subcontractor.
If the yes wins: responsibility extends to the client entrepreneur also for « specific risks ». Objective: the white deaths are as far as possible. The opposites fear the blocking of the works.
Gialla – Italian citizenship
The Question number 5 It concerns Italian citizenship for non-EU citizens of age. We ask to repeal article 9, paragraph 1 law 5 February 1992, n. 91 Only in the part on the minimum time of legal residence in Italy, now set at 10 years.
If the yes wins: The minimum time required is halved and the foreigner who has legally resided in Italy without interruption for at least 5 years can request Italian citizenship, as happened before 1992. The other requirements remain intact (income, language). For promoters 2.5 million foreigners could become Italian in all respects. For the opposites, 5 years are few for a real integration.
