Publication of the video, the Prosecution records criminal proceedings for “Detection of Secret Data”

The Prosecutor’s Office of the Court of First Instance of General Jurisdiction, Tirana, registered criminal proceedings for the offense of ‘Discovering Secret Acts or Data’ provided 295/a after publication in media and portals of a video on the Elementary School ‘Fan Noli’, where Mr. Mituri lost his life

The video published in some media features film footage dated 18.11.2024, showing juveniles with their generalities’ labels alongside everyone. In the framework of the investigative actions carried out in connection with this proceeding, a CD with film footage recorded by security cameras that have fields on the road to the scene has been administered in the capacity of material evidence, which is documented by the record and material evidence by the Judicial Police.

Film footage, which were published two days ago in the media, also distributed on some on-line portals, contain the same film footage that is also located in the CD that was administered in the investigative file. At the conclusion of the investigation, the CD with film footage disposed of by the Prosecution, was made available to the defender of the victim’s family members, the lawyer, who has taken him and all the acts of the file, against the signing of the statement of his non-publication.

This case is currently under trial in the Court of First Instance of General Jurisdiction in Tirana, where the trial is being held under closed doors. It is concluded that in the present case, with the publication of the video, the two obligations provided for in Article 103/1, 2 of the Criminal Procedure Code have been violated after evidence (video) that are acts of closed -door judicial review and published with videos, photos and generalities, victims and minor witnesses of this case have been published.

In the above, there is sufficient evidence that the elements of the figure of the offense « Detection of acts or secret data » provided by Article 295/that Criminal Code have been consumed.
