The Basic Public Prosecutor's Office for the Prosecution of Organized Crime and Corruption, following information transmitted in certain media, informs the public that for the procurement of fuel oil for TPP Negotino of questionable quality, the Skopje Basic Criminal Court submitted the pre -trial judge's decisions that the prosecution's proposal was accepted. As reported, a pre -trial judge at the Basic Criminal Court Skopje last night ordered 30 days' detention of businessman Ratko Kapusevski and two others covered by the investigation to procure crude oil for TPP Negotino, and the owner of Puzko Petrol.

– In the explanation of the decision it was emphasized that the pre -trial judge in the decision had taken into account the circumstances prominent in the prosecution's proposal, but at the same time he had in mind the subjective circumstances on the side of the suspect, ie that by the decision of the Basic Civic Court Skopje he was the guardian of his four children, and his four children, His health has been disrupted for which he has submitted documentation – the prosecution said in a statement.

All of these circumstances, as noted in the solution, are in favor of a reduced risk of escape and aimed at justifying a milder measure to ensure the presence.

« Thus, the pre -trial judge, not accepting the prosecution's proposal, decided to impose a house arrest measure, and at the same time assessed that the conditions were fulfilled to be imposed and precautionary – seizure of a passport and ban on issuing a new passport. »

The prosecution, in cooperation with the judicial police, is taking action aimed at providing evidence of ownership and real estate of the suspects in order to secure them for further confiscation.

The Criminal Court announced last night that after the public prosecutor and the suspects in the presence of their defenders, regarding the proposed measures, as well as the appreciation of the facts, accepted the proposal of the Public Prosecutor with which RK, AM. and ES ordered them to be detained for 30 days, and due to the existence of the foundations of Art. 165 para.1 t. 1 and 2 ie the danger of escape and circumstances indicating that it will impede the investigation with the influence of witnesses.

« Regarding the suspect, AJ, after the suspect was made before a pre -trial judge, the public prosecutor agreed to change the proposal for detention with a proposal to determine house arrest, which was accepted by a pre -trial judge, » the Criminal Court said.

For the other seven suspects in court, the judge accepted the public prosecutor's proposal and adopted resolved precautionary measures.

Against these decisions, the parties have the right to appeal before the Criminal Council.

With the intention of playing the contract, they did not commit the obligations and violated the rules, benefiting a large scale for the criminal legal entity and to the detriment of the state budget in the total amount of 10,304,324,094 denars or about 167,549,985 euros – the prosecutor's office said.

The intention was helped by employees of AD Northern Macedonia – Skopje, which were in senior positions by CEO and Directors of Departments to Presidents and Members of Public Procurement Committees, conducting public procurement procedures against the instructions for the manner of conducting public procurement. 24.02.2023.

– The funds that the suspects obtained with the crime, which represent an illegally achieved property benefit from the public call of AD Northern Macedonia – Skopje, in the period from December 2021 to April 2023, were released, changed and transferred to another. With some of the funds they bought two Mercedes Benz motor vehicles, some transferred them to their accounts in various banks and then raised them in cash. At the same time, on the basis of a mediation agreement and an annex to the contract, concluded between the suspected legal entity and a suspected legal entity with the same activity, funds were transferred to 72,000,000.00 denars for allegedly performed work under the contract that was only a apparent means of performing the transactions. The suspect, so received funds, aware of their origin in order to cover up their location, transferred them on the basis of « loan » to his legal entity – the prosecutor's office explained.
