After the violent clashes between Chechen and Syrians in Vienna last year, two Chechens aged 29 and 30 stood before the regional court in Vienna on Monday. The indictment takes you attempted murder. The 30-year-old admitted to drove to the Anton-Kummerer Park with his dark BMW. He had been trained in a gym and had learned from a compatriot that his younger brother had « stress ». It was decided to go to Brigittenau with another Chechens present in the Gym to support. « Let’s help, it’s about the little brother, » the 30-year-old recalled his thoughts at the time.

Arrived there, his companions had suddenly pulled out shock pistols and had walked into the park. Then he would have heard shots: « I got on and quickly left. It was 100 to 150 meters away, I didn’t want my car to be broken. » He also searched the width « out of self -protection ».

Silent defendant until the negotiation

The man was arrested on July 6th. Since then he has been in custody and has made use of his right to refuse to testify until the main hearing. When asked by the presiding judge, why he had not said anything if he was innocent, the previously unspecified project manager, a trained mechatronics technician noticed: « Because so much happened. I did not want to comment on the main hearing. »

The 29-year-old had not yet given any information. According to the crime plan, he is said to have accompanied the main accused, with whom he has been friends for 14 years. According to the indictment, the younger also armed himself at the scene, but he could not prove that he could use weapons. The indictment assumes that he would have « encouraged the 30-year-old at least mentally with his shot ».

The 29-year-old said that he did not go to the Kummerer Park together with the main accused, but together with a friend, with whom he had had an appointment near the pizza meal: « Suddenly everyone went into the park. » He wanted to see what was going on there, « I heard and shots. » When he felt « men with a Mediterranean appearance, Arab » with T-shirts and weapons in his hands pulled over his head, he preferred to withdraw with his companion: « We were then football in a sap. »

Defense lawyer convinced of acquittals

On the one hand, the 29-year-old is burdened by the result of a call data recording. However, he does not deny that he was near the crime scene. On the other hand, his belly bag was secured in the BMW of the main defendant. The 29-year-old said that he had met his friend in the afternoon and accidentally left the bag in the car. His defense lawyer Florian Kreiner was convinced of an acquittal: « He did not fight or otherwise participated. There is no evidence that he was next to it. »

The information from witnesses and a shooting report speak against the main defendants. Seals had been discovered on his clothes and on the steering wheel of his car. The 30-year-old and his defender Alexander Philipp said that the man was in Bratislava the day before and tried several firearms, including a bell. A few hours before his arrest, he cleaned his own weapon after the shooting exercises in Slovakia at home.

In the investigation, witnesses had described and stated the dark BMW of the 30-year-old that three men armed with pistols got out of the vehicle and went into the park. The witnesses had not identified the main defendant in a comparison, the prosecutor admitted in the trial. As a result, his legal representative also assumed that he can « only be acquitted. »
