Prison sentence for Ivanov for a lawyer misleading a supposedly prepared murder / day
Men convicted that lawyers Alla Barbash (Jurash) misleaded the alleged murder of him.
Ivanov has been sentenced to one year and nine months’ imprisonment, while Goncharov has been sentenced to one year imprisonment, as well as public work for 170 hours, LETA informed the Supreme Court (AT).
Ivanov was also accused of purchasing and storing the blast, firearm and firearm ammunition without a permit.
For Goncharov, the first court instance sentenced one -year imprisonment, 170 hours of public service, depriving the driving of the driving license for five years, and Ivanov for one year and nine months.
Appeals were received for the judgment. The Riga Regional Court also upheld the judgment of the Court of First Instance, but the judgment was appealed at the AT.
The AT stated in its decision that the complainants had repeated appeal to the cassation complaints about the arguments of infringements in assessing evidence and the qualification of the accused’s activities, which the court of appeal had been assessed and motivated by the court.
Similarly, the decision emphasizes that the references in the cassation complaints of the accused and the defense of the Criminal Law and the substantial violations of the Criminal Procedure Law are their subjective opinion on the evidence of the case obtained in the case of the assessment of the evidence, confidence and adequacy. While under the influence of alcohol, Goncharov sent two text messages from his cell phone number to Ivanov, in which he ordered the lawyers to inform you of being ordered for killing her. After receiving these text messages, Ivanov came to the lawyer’s office and informed the lawyers that a murder was being prepared.
The next day, when both accused met, the information sent in the text message was Goncharov’s fiction and that there was no threat to the lawyer.
In spite of this information, Ivanov, as he continued to mislead the lawyers, contacted him by telephone and informed that there is still life threatening, thus maintaining and also enhancing the misconceptions of the order murder.
Ivanov has promised the lawyer to resolve the situation and settle everything by meeting with him only people who have a connection with the planned murder. Thus, with his influence, he will prevent the lawyer from being killed.
These actions were qualified as hooliganism, which was manifested as persistent, long -term and demonstrative action, against lawyers and disturbing the victim’s peace, because she was afraid of the freedom of movement and actions for fear of her life threatening, which did not have the ability to meet her family.
The victim was also forced to terminate their professional job duties and did not get a weekly financial income, and the work of the law firm was significantly disrupted – to provide the planned legal assistance to others and to attend the hearing.
Ivanov was also accused of illegally holding a firearm « Smith & Wesson 386C » with ammunition, as well as blasting. These items have been removed by the State Police during search.
Ivanov came out several years ago after a nine -year prison sentence for ordering his wife Ella Ivanova’s murder.
