President offers parliament to ignore the constitution


Dnevnik publishes the public address of 40 lecturers from the Faculty of Law at Sofia University « St. Kliment Ohridski » regarding the idea of ​​President Rumen Radev to propose to parliament to decide to decide to the parliament to hold a referendum for Bulgaria’s accession to the euro from 2026.

As people who have chosen the right to their professional vocation and life path, and led by the responsibility of teaching the right to the coming generations of Bulgarian lawyers, we feel obliged to express our deep alarm and to alarm about the danger of the National Assembly, to convene a national referend. In the presence of decision №3 of 8.02.2024 on the c. No. 13/2023 of the Constitutional Court of the Republic of Bulgaria, the convening of such a referendum would be a violation of the Constitution. It is legally unjustified that the President of the Republic propose to the Bulgarian Parliament to ignore the constitutional regulation of the country and its obligations as a member of the European Union.

Such an act undermines the confidence between Bulgaria and its partners in the European Union, undermines its international authority and, above all, calls into question the constitutional foundations of the Bulgarian Democratic State and the principle of rule of law – fundamental to the Bulgarian legal order.

We have to remind you that democracy is a completed model of organization of society, public authority and law. This model guarantees a management based on the will and rights of citizens, expressed and protected in the forms established by the Constitution.

The attempt to put Parliament in a position to convene an unconstitutional referendum is an act that – consciously or not – aims to suspend the Bulgarian Constitution and the return of the country decades ago, deleting the achievements in public and legal progress after 1989.

We urge the professional community of Bulgarian lawyers to take a definite position in defense of the rule of law and development of Bulgaria as a democratic European country, in accordance with the Constitution and international commitments of the country.

We urge the National Assembly not to violate the Constitution and not to question the place of Bulgaria in the European Union.

We turn to Bulgarian citizens with a call for a conscious and responsible participation in one of the most fateful moments in our contemporary history and, through our active position, not to allow our country to be brought back to its development as a free, legal and democratic European country.
